Judge: Tubes Cannot Profit from Users' Copyright Infringement

YNOT ? A U.S. District Court has awarded San Francisco, Calif.-based Titan Media more than $1.35 million in damages from a company owned by two German men. According to the judge?s ruling, Antelope Media LLC?s ?tube? site allowed users to infringe the gay adult studio?s intellectual property rights with impunity while Antelope profited from advertising and membership fees.

I remember talking to the attorney Gil Sperlien at Internext... he had just served the monstercocktube guys who were swimming in the pool right behind him. We've often seen or heard about someone getting served at a show... perhaps we'll see more of it?

So they cannot move the domain name to another company, and they cannot move the proceeds. But what about dividend payments? Paying didends to a trust and it would be extremely hard to go after those proceeds. But they'll be digging in themselves further if they do so

yes I read that in the AVN article post like 3 days ago and also saw the post a bit down where the forwarded the domain to a new one and still are running fine. According to "some other webmaster forum" they were doing around 1.2 million/year gross.

10 mill would be impossible.

Also, they are a "tube paysite". They earn FAR more than a regular "affiliate upsell" type tubesite.

To borrow a classic line from Pulp Fiction "Don't suck each others dicks just yet"--it was a DEFAULT judgment. The value of this is that it does send a message. The question is does the message reach those who hide behind offshore servers and have no US contacts?

may be great news.... may just be posturing for an argument on grounds of improper notice or some other legal loophole. They didn't respond to the pleadings... there are many reasons a company would choose to do that and 'surrender' is only one of them.

this case has more to do with showing up vs not showing up.

although the rapidshare case would go a long way in the appeal because even in a case where the defendent doesn't show a judge doesn't have a right to ignore the relevent laws.
