I'm really NOT Ok here

this is really really bugging me - I'm NOT OK with this

the ex-employee thief who broke into my business and stole over $30K from me got the charges dropped today mostly cause the cops "forgot" to include all the evidence.

Basically he legally gets to KEEP everything, no criminal record and I'm stuck in bankruptcy

this isn't right

I'm looking into other LEGAL actions to go after him and/or cripple his income.

Welcome to my world, Had a guy come into my retail store, he was being an obnoxious pig so I kicked him out. 5 hours later he came back and sat in the car sent his 18 yr old daughter in, the minute my back was turned, she cold cocked me, the whole time dad is in the car yelling, egging her on. She was arrested, went to court and walked away scott free, not even a slap o the wrist. It cost me $2500 easily.

Cops and attorneys screw everything up, so I now have a baseball bat instead.

It seems like you pretty much have three options.

1. Sue him in a civil court. It could cost you legal fees and if you win there is no way to know for sure how long it could take to recover any damages you win, but you could recover a decent amount of what he took and even if you end up having to take his property and garnish his wages, at least you get the satisfaction of knowing he is paying for what he did to you.

or

2. move on. Getting more and more pissed will only tear you up so you move on with your life.

or

3. You work to figure out if he has any other illegal activities and try your hardest to get him busted for those. It may not get your stuff back, but if he ends up going to jail for something it could help you get a little closure.

I have a judgment on him already - he refuses to pay. it's an asset in my bankruptcy which I can't do anything with till i'm released then which I think i'll try and buy back ($10,000 for the first robbery) i'll probably be able to get it for $500 and then seize some of the tools back from a job site. It's good for 10 years

anything more than that is a waste of my time as when you seize stuff you get to count it as USED AUCTION value so I can seize probally $50,000 in replacement value of stuff. He doesn't have more than that.

- move on - i'm trying - today was a WHAMMY though - didn't think the gov't would drop the case against him. I seriously think it's tied to the dirty cop that helped him rob me the first time - the more he's scene as innocent the harder it is to prove the cop is dirty. I'll calm down but that will take time.

when i want to walk away with people's money I use a legal tool called bankruptcy and give up everything I own and subject myself to all that it entails.

with the judgment when I'm cleared if I can buy it back I can use a sherrif and basically do just that BUT legally though....

I feel your pain. A few years back I had a so called friend steal my identity and run up about 40K in credit as well as about 6K in bad checks. It took a while to track him down and when they finally caught him the county prosecutors cut him a deal. He pleaded guilty to a few of the things he had done to me and to a battery charge and he got off with a short sentence and probation. They decided to go this route because he already had one conviction for assault and at the time he stole my identity he had a warrant for domestic violence. So with two violent convictions he has two strikes. One more and he goes to jail for at least 25 years.

It all sounded good to me, but then a few of the creditors that he had opened up accounts with still demanded their money. There was no security camera footage proving he was the guy that opened the account and with no conviction they decided to come after me for the money owed. I eventually got it all straightened out, but it cost me about 3K in legal fees and a hours and hours of headaches.

Well the best you can do is the judgment really. It's not just good for 10 years either, you just have to renew it after 10 years.

If he ever wants to get a job where they do a background/credit check beforehand, that will show up. The only way he can get the judgment off his credit report is to settle with you or file bankruptcy.

If/when he gets a steady job you can garnish his wages also. So while it may not "feel" like a proportional response, you can still slowly extract your pound of flesh, legally.

Stuff like this really sucks. My old partner was into expensive go-kart racing with his sons a few years back when they had a bunch of their gear stolen, including a one of a kind painted helmet for his son. He had an idea of where it was at and was driving around the neighborhood and saw it all in a yard, called the cops, and while it had all been reported they did nothing for him. He could see it but could never legally get it back.

Did the prosecutor drop the charges with prejudice? If so, if the cops get their act together they can refile and bring him to court again. At least in my part of the world it works that way. Half the time, they will drop charges against someone in the courtroom, then re-arrest them as they walk out the door.

We had an ex-employer giving my family shit for 2 years after my husband quit a job once. I ended up having a nervous breakdown and so did my husband. She stalked my family so bad and because she was rich, the cops didn't do shit to her. We ended up moving to 3 different states to try and find work and we couldn't because she kept finding us and calling the places and telling them that my husband was anything from a thief to a violent person, which couldn't be further from the truth.

This bitch even went so far as to catch her own house on fire and call the cops and give them my husband's description....... thank GOD we were in Texas when it happened so we had a clear alibi, but wow, she all but destroyed our lives for about 3 years.

My kids are still a little freaked out over that breakdown we had to this day. It's hard on young children when BOTH of their parents breakdown at the exact same time. And in a 3 year time span, we lost both of his parents, a baby and were stalked and ran all over the country trying to just survive and keep them from all of it.

SHE, to this day is walking along in her life doing what she does and never paid one fucking minute for the hell she put my family thru. We were so obsessed with tearing her down that we almost lost everything a second time. It was only when we gave it up that WE could move on. My husband finally got work with one of his close friends and I got work in the Porn Industry to help him make the bills.

Wow.... never spoke that out loud before.... my point is, don't let this drive YOU crazy making him pay, people like that never have to pay, not on this earth anyway.

It's rediculas how the courts are always cutting deals and dropping shit, I think it's totally bullshit. If you do the crime, you should do the time, nobody should get a break. Maybe if they ran things that way, there'd be a bit less crime going on.

A prime example of that is a guy that lives around here that I know. He's got a massive history of violence, from totally climbing over the counter at a gas station and beating the fuck outta the cashier because he wouldn't sell him alcohol when he was under age, to him sneaking into his ex-girlfriend's appartment and beating the fuck out of her, breaking the bone in her eye socket in FRONT of her kid. I could go on and on, there's also the guy that he beat the fuck out of with a lead pipe, but yet this guy gets a slap on the wrist and is back on the streets, I thought that crimes piled up against you after you repeat and repeat and reapeat. One day he's gonna kill someone.

really bad stories here, I bet sleazy you will never trust an employee again. Most Cops seem to be just incapable. I remember some of those freaks running around my Golf MK2 to find anything illegal to get me out of the streets, instead of hunting criminals (embarrassing).

Yeah, our three strikes rule is cool. Some criminals will get more than 25 years depending on what their third strike is, but even if this guy so much as grabs his girlfriend and leaves a bruise and she calls the cops he is going away for at least 25 years.

no he wasn't from the industry.

worst thing I had from the industry was someone didn't pay me - happens, people have shit that goes on in their life. I had many deals go bad and many for a lot more money than the one most know about on here.

I'm over that - I was more pissed that person told me they were only my friend for the money then for the financial loss. It was pretty clear too. That's where I got really hurt there.
