there is a "fair use" policy that allows websites to use content for news\reviews etc. read up about Mrskin - i think they had a pretty big case about it

but you cant just steal it and resell it to other webmaster. he has no copyright documents for it anyway.

Even if it is legal. So are user uploaded tube sites, yet everyone here still calls them "illegal tubes" and says they are stealing and its theft, barefootsites himself has been pretty open that he is against tube sites, crying in many a thread.
