AVN would have a lot to prove to a jury to even get a little sympathy, and it'll be nothing compared to what they'd have to do in order to get the industries sympathy. The only thing I can imagine is that they are hoping for a settlement, and that it never even goes to trial.

I am pretty sure, unless you are an executive with the company, they can't prevent you from going to work for a competitor in California..although I could be wrong. But specifically to the Ad and online publishing arena I have a very hard time believing that AVN has a lock on any trade secrets that anyone with half a brain and the will to search Google can't uncover on their own. Again this is just my own opinion.
