Going after someone who charges back

Ok someone charges back.

I got the username access logs and the ips of that person. All info of this person was typed in correctly and points to this person. He was member for 2 month and was inside the members section 45 of the 60 days and then charges back 2 x US$ 24.95. The person is in Canada.

Is there really no way to go after those people?

To see if I can. This would not be 50 bucks but also any cost affiliated with this chargeback.

If I chargeback 'Best Buy' for 50 bucks they sure will go after me.

If we don't start going after those fucks it will never stop.

Call him and tell him that if he ever pulls that scam again, someone will show up at hit house with a baseball bat.

I think that should be the default phone call to anyone who charges back after 2 months.

nah.. just write up a letter with the site name and all info about what service were used and how often.. and ask for clarification on the charge back.. simple and to the point.

and if being polite doesnt work, your not gonna get a dime anyways, then its time to get even

keep a list of the guys who have charged back, and once in a while send em a letter reuqesting they settle this outstanding balance. but send it in a lude and very descriptive envelope.. so even the mailman knows whats going on. try and hid that from your wife.

It would cost almost nothing, and it would just feel so good

If everyone did this, imagine how it would impact thess chargeback BS'ers.

If unable to resole the matter with your merchant account bank...(the actual bank, not Card Services etc.) if the merchant account is in your name. there are other options that if you do it right won't cost you any out of pocket money.
depending on the number of chargebacks, gather them up (names and addresses of debtors)
go to the clerk of your local small claims court, and file.

I told the clerk that I could not afford the $34 filing fee (which was true). she had be complete a small card that basically stated that I requested the fees be waived, due to HARDSHIP.

Sometime ago, I did a few, and won default judgments in the 2 that did not get settled prior to court. I listed both cardholder and their bank as defendants.
The banks almost immediately within a week or so, contacted me, and reversed the chargeback.

The other two I sent to collections. Remember there are collection agencies who will take a attempt your bad debts. You don't have to be owed a million dollars to enlist the services of a collection agency. If they are by some slim chance able to collect, you'll only see pennies on the dollar.

I know the feeling, like someone betrayed you. This hit me real hard loosing the excited feeling that total strangers had joined my sites, just to be shot down 3 months later when that bright blue envelope arrives in the mail informing you somebody wanted their money back

Post his name and address here on this board and every other board on the net.

Post his name on your site as a deadbeat, start a whole list of deadbeats right on the first page so everyone sees it, I am sure he wants all his friends to know about his porn activities.

And if you are as evil as me, do a mass mailing of his town looking for new members for your site and sight your deadbeat as a happy and satisfied customer.

Oh yeah, if you are a real prick.......post a bounty for someone to pay him a visit and fuck up his knee caps. That one always works.

I cant believe how bad some of you guys whine over a chargeback, Its like 29 for a month sometimes cheaper.... And dont give me the whole "they ate up my bandwidth" they probably did not download more then 2 gigs (very generous estimate) and that you can get for a total of 65 cents... Yes i am aware of processing fees but oh well, you win some and lose some

You know it really is possible someone didn't make the charges. It happened to my visa about 3 years ago before I got in this biz. I even know when my card number was stolen, it was while getting my credit approved for buying a cell phone, the teller went in the back to make a call, came back said all is good. Anyways, I go home, everything is normal and I get 2 charges from Xpics.com on my visa. I contested the charges and got them fully refunded.

Lesson: Not all chargebacks are deadbeat losers who don't want to pay for porn. A lot of them are typical people who simply got their visa number copied from when they weren't looking.

Just a thought...

I think it's about time that a public (well not public but accessible) database of scumbags is created and anyone who is worthy could use it provided he contributes to it.

Do you run any paysites? My guess is no.

It's not like it's just one person charging back, assholes like this can become a problem. Some people care about profits, I don't know about you.

Both of you missed the humor of my post. I guess I am not a very good comedian. It was suggested that a baseball bat be used, my "witty" come back was that I own a gun. Oh well I guess you had to be there.

I don't know how much this will help in YOUR case...but it often does the trick in mine. I keep this on the fraud section of my website, and once I get a charge back, I send it to the callers e-mail address. If I get no response, I send it to his home address, this is of course after I call him (phone sex, so we get their numbers)

WARNING!

As a member of the Anti-Fraud Coalition, this service is committed to putting a stop to fraudulent credit card and check transactions in the internet sex industry. We have enlisted the aid of a nationwide collection agency who will pursue these criminals and either collect on their accounts, or surrender our phone company records and transcripts to the FBI for criminal investigation. Please remember that our service will be billed as (company name) on your credit card statement. If you ever have a question about a charge on your statement, you may contact us at (e-mail here)

Fraud is a FELONY

Please note that it is fraudulent and illegal to dispute or deny that you made a charge for a call you placed. When we receive such disputes, this is our Dispute Policy:

1. IF YOU TRY TO DISPUTE or DENY a valid charge, your credit card number along with your name and address will immediately be added to a negative database. The negative database is shared by thousands of merchants on the internet, both large and small, and you will not be able to purchase goods or services from said merchants in the future.

2. IF YOU TRY TO DISPUTE or DENY a valid charge, you will be sent an invoice for the disputed amount by regular postal mail. A copy will also be sent to your bank and credit card company. The invoice will include the following information:

(a) The name of the service you paid to access
(b) The phone number you called into our toll free number from
(c) The date and time of your call, and the duration and name of the talent you spoke with
(d) Original charge amount owed plus a $25 fee for dispute processing.

3. If you do not pay the invoice within 30 days, a second invoice will be sent. The second invoice will include the following information

(a) A copy of our toll free phone bill that shows what number you called us from, along with the date and time
(b) A copy of the phone bill showing the duration of your call with the talent.
(c) A detailed account of your conversation, and any special requests you made when you ordered the call

4. If the second invoice is not paid within 30 days, your file will be forwarded to the following offices for processing:

(a) Our Collection Agency for further collection action and entry on your credit report
(b) Your local District Attorney for Fraud Prosecution
(c) The Internet Fraud Complaint Center - a partnership between the FBI & the National White Collar Crime Center
(d) Contacting our attorney and starting criminal procedures in which you will prosecuted to the fullest extent of the law.

To avoid any of the above, we encourage you to contact us first for any problems regarding your purchase from our service. We have an excellent track record in resolving any problems to see that you are fully satisfied with your purchase.

If you have any concerns about your purchase we encourage you to contact customer service by phone at xxx-xxx-xxxx, or by emailing us at (e-mail) with your full name, the date and amount of the charge in question. We are always here to assist you with any complaints or problems you have.

Naturally, if none of this works, I call the fucker and tell him I have NO problem taking out a FULL page ad in his local newspaper supplying all his information and exactly what a fucking freak he is!!! I also put their name on my website...along with where they live, and what they wanted in the call. I also get the phone numbers of their family and neighbors. yeah I'm a bit anal when it comes to charge backs, but I have an EXTREMELY good recovery rate. But for 50.00? I really don't see going through all the steps I have listed here. I would just send him the above and see if that scares him enough to pay the debt and I would call him and threaten the pants off of him. I've been in business 3 years and I have had TOPS 50 charge backs and have recovered more than half, the rest were just stolen cards that I had no control over. =(

Just my

Yes, it is possible. But the vast majority of chargebacks come from the legal cardholder...or more accurately, his wife who he has told he "never signed up for an adult site, honeeeeeeey."

I realated this before, in a different thread, but I once heard one of these assholes actually bragging about how he had a bunch of credit cards that he rotated when buying things online and then charging them back. (My girlfriend wanted to kill him.)

It's stealing, pure and simple.

And the truly sad, pathetic fact is, VISA, MasterCard and the rest of the plastic nazis know it. But they are so scared of offending their cardholders they are shifting the blame.

If it's a legit credit, fine...but that is such a small percent it's insignificant. And it's also true there are some webmasters who offer crap and deserve to have people chargeback...but say it's for lousy content, not that the card number was stolen.

I agree with the idea of a database, listing these jerks names, and any other information we can put together. Who wants to register the domain?

Brutal
