GFY Legal Experts- Identity theft (within family)

I have a friend who's dad opened up several credit cards over the years using his sons identity... they have the same name (friend is "Jr")

He's fucked, he just realized he can't get any $ to move.. can't get a car... and I think a couple of jobs turned him down because of it as well.

It sounds simple enough, report him... let him deal with the feds. The prob with that is that his dad just had a stroke like 2 months ago and is pretty messed up... now my buddy is torn.

What would you guys do? Is identity theft guaranteed jail time?

His dad is a dick too, every time he tries to get the $ back from him his dad just starts yelling at him (cop out)... so he's leaning towards "fuck it" and doing it but he's trying to find out what he might put his dad through.

The icing on the cake is that his mom is trying to kick him out and he can't get a job at any kind of retail store because of this (he just found out after months of getting turned down).

He's broke, can't afford a lawyer so I'm going to talk to one of mine for him in a couple of days... in the meantime, what do you guys think?

Why not report him? Is he such a fool that he thinks his dad gave any consideration about what he was doing to him?

i think though you have to go to court first and swear that you were victim of identity theft..

and fuck hios dad.. anyone that would do that to his own son doesnt give a fuck about them....

A retail store cannot turn him down for bad credit, are you smoking or just stupid. Only reason they would turn him down is because of bad job references or criminal history. He is also stupid to give his POS dad a break. Oh this bullshit about cant afford a lawyer. First off, a lawyer will take the case and get paid later, he can sue his dad and for him even caring about putting his dad behind bars is just stupid. his dad fucked him and its his son, he needs to fucking clear is name end of story.

Does not mean guarentteed jail time, specially if he recently had a stroke. Just would depend on if the DA wanted to really prosecute. Hell often even that is left up to the credit companies since they were the ones frauded. From what I have seen they often do not do shit.

Just cleaning it all up can suck serious ass and take an extreme amount of time. As stated he could even get a clean SS number. He would just really need to get the ball rolling and get the reports filed with the authorities. Plus it is fairly obvious his dad did not give a rats ass about his future well being.

Maybe it's something like domestic violence. You can file charges but you don't have to pursue them. So maybe he could file the report to get the ball rolling on fixing his credit, but not press charges.

Actually, I think this is pretty common. I remember reading a few stories that are similar to this.

You post this idiocy and you have the balls to call someone else stupid? Retail stores can and will turn you down for a job if you have bad credit, especially if it is a management position. Most large retailers do credit checks in addition to background checks now because you are considered high risk for theft if you have bad credit.

As for a lawyer taking a case and getting paid later, that only happens with personal injury or other cases where a cash settlement is highly likely and the lawyer generally gets a third. You honestly believe an attorney will take a case like this on a contingency? Split Infinity does itself a huge disservice by allowing you to continue to make an ass of yourself on here...

As someone who has gone through this I can give you some advice. I had a so called friend steal a few of my blank checks. He then printed new checks with my name and account on them, but a different address. He wrote around 5K worth of checks which drained my bank account and opened up around 30K worth of various credit cards and charge accounts in my name. In the end he went to jail, but for a different crime, not the identity theft. The DA told me flat out if they got him on just the ID theft, since it was his first time getting caught, he may just get probation.

Here are a few things he needs to do. First, contact the three major credit reporting agencies and put a fraud shield on his account. This way anytime someone tries to open an account the creditor is required to call the number he gives them and verify the identity. Since it was his dad there will be no more new accounts, but at least it is reported. Second, go to his local police department and tell them what happened. They will give him an ID theft kit with all kinds of things he can do to get the bad stuff removed from his credit and fix the problems. This will most likely involve him having to turn in his dad. Tell him to sit down with the cops and explain the situation. Because of his dad's health it is hard to say what they will do to him. At the very least his situation will now be an official police case so when he goes to get a job he can tell them he had his ID stolen and that his credit is screwed up because of it. He can even give them case numbers and contacts if the employer wants them to verify this. He will most likely find the police and the prosecutors to be very sympathetic to his case because they deal with this shit all the time and know it isn't his fault and that it was his dad that did this to him makes it even worse. There is a very good chance he won't need to get a lawyer, but down the road he may. At least this will get him on the track to recovering things and getting his good credit back.

That he needs money now and a job now sucks, he may have to suck it up and go to a temp service or something just to get some cash coming in to hold him over until he gets things fixed because this isn't something that happens overnight. It took me more than a year to get everything cleared up.

I have known people in this position, his best bet is to go to a credit professional and dispute every charge on his credit report...

From there he needs to get three open lines of credit... A savings and checking account..

In 6 months he should be sitting alot better and able to move forward...





He does not have to turn his dad in...

His dad messed up his life by doing this, don't let it be a life sentence. Debt like this carries for years and years, get the feds involved to try and expunge this from his records.

It is not a death sentence to his credit... He can dispute all the activity that his dad did and move on...


He said the guys dad had a stroke, ect. he might not be around to long....



Seriously, do what I said, problem is fixed...


He can build his credit from there... Any activity will get flagged so he has to worry about it no longer...


Three lines of credit, and the accounts.....

Once he is up over 700 he will be proper and be able to do what ever he wants..
