Hey guys, I have a quick question regarding the legality of buying amateur content...

So, Im about to purchase a bunch of amateur content from someone I met here on GFY. I asked him to send me any sort of disclaimer or something like that stating that this content is licensed or at least legal for me to use freely and way I like.
He says, I am able to use this content freely because it was collected from tons of various user submitted forums, sites, and social networking sites.
IS THAT TRUE?

Can anyone here show me where I can go to read up on something like this? Is there anything written that says I can freely use content that has been user submitted?
I am just trying to cover my ass, I dont wanna get in any trouble once I start using this stuff.

Exactly. Unless you have your prrof of age (copies of IDs and what not), as well as permission you COULD be fucked.

Most TOS state that images kept on a site (such as Myspace, Facebook, FUBAR, etc) state that all images and whatnot are intellectual property of the site they were originally posted on.

This is not to mention the fact that if someone was to come across their own image, or even worse a co-worker or friend of someone in the image. The original picture object could turn around and sue you for a million different reasons. Defamation, copyright, etc.

Verbal agreements don't work these days.

Get stuff from people with knowledge & excellent reputation that have been in business for many years where you can get references from.
These people cover your ass when shit goes wrong instead of leaving you hanging to dry

"7.1a Licensor warrants that all models appearing in the content were eighteen years of age or older at the time the photographs or
videos were made and that the licensor has contracts with the content providers/photographers/cameramen/distributors that they
have these ID records and model releases in their offices. These documents can and will not be made publicly by us to protect the
models identity, address and real name as is the law in some countries where the productions were shot and by our choice too. In
the event any authorities have reason to believe a model is below 18 years, we then will request the ID & model releases from the
producers against a to be arranged hourly fee for all the paperwork and man hours. This we can solely in the case you can show us
a written request from the government. "

Do you actually charge your customers if they come to you with a request for the 2257 docs because the government wants to verify? I am pretty sure the government isn't going to pay you to provide the documentation. Your customer shouldn't have to pay you either since you aren't making available to them to cover their asses.

When we have them in our office we supply them to our clients upon request (some are even included already in the .zip depending on what kind of content it is).
If they are not available or older the july 1st 1995, it says so on the page where the product details are so clients know this BEFORE they buy.
