Mexico has told the USA to stop the execution of it's citizens

If the US allows this, Mexicans can come over to the USA, rape and kill and only have to do a life sentence. No fear of being fried on an electircal chair for them.

THE HAGUE, Netherlands (AP) -- Mexico made an emergency appeal to the U.N.'s highest court Thursday to block the execution of its citizens on death row in the U.S.

Mexico's chief advocate Juan Manuel Gomez-Robledo said the U.S. was ''in breach of its international obligations'' by disregarding a 2004 judgment by the U.N.'s International Court of Justice, which ruled Mexicans were denied the right to consular advice after their arrests, as guaranteed by an international treaty.

The court, informally known as the World Court, has ruled that the Mexicans were entitled to ''review and reconsideration'' of their trials and sentences to determine whether the violation of the 1963 Vienna Convention affected their cases.

President Bush accepted the judgment and asked state courts to review the cases.

Texas refused, and the issue went to the U.S. Supreme Court, which ruled last March by a 6-3 vote that Bush lacked the authority to compel state courts to comply with the judgment from The Hague. The Vienna Convention cannot be binding on the states unless Congress enacts legislation enforcing it as federal law, the Supreme Court said.

Mexico asked the World Court for an ''interpretation'' of its earlier ruling to clarify what it meant when it asked the U.S. to ''review and reconsider'' the cases of the condemned prisoners, and in the meantime to order the halt of the execution timetable.

Gomez-Robledo said that without urgent action now, five Mexican nationals ''will be executed before the conclusion of these proceedings.''

U.S. representatives were due to respond later Thursday before the 13-member tribunal.

Sandra Babcock, representing Mexico, said the World Court's decision four years ago referred to 51 Mexican nationals. Since then, 33 had sought reviews of their cases in state courts.

Only one request was granted, Babcock said. A second inmate accepted a life sentence in exchange for waiving his claim for a review.

''All other efforts to enforce the judgment have failed,'' she said.

Mexico listed five of its citizens slated to die. The first, on Aug. 5, is Jose Medellin, 33, condemned in the gang rape and murder of two teenage girls 15 years ago.

Texas authorities have said Medellin's case has been reviewed by state and federal courts and that he had been given the same right as any American citizen.

But Mexico said in its appeal to the World Court that the U.S. obligation to follow international law also applies to individual states. ''The United States cannot invoke municipal law as justification for failure to perform its international legal obligations,'' it said.

The International Court of Justice is the U.N.'s judicial arm for resolving legal disputes among member states. Its decisions are binding and not subject to appeal, and only rarely have they been defied. Though it has no power of enforcement, the court can report any failure to abide by its decisions to the Security Council.

Well people come from other South American countries and come up through Mexico. So many of the so called "Mexicans are from other countries south of the boarder but most are Mexicans.

Then there are of course the illegal Chinese & Russians which are probably a bigger problem in big cities like New York but nothing like the Mexican problem.

Personally I'm all for letting anyone have a chance and work if they can find it. However they need to follow the laws and not abuse our system.

And so what is the problem? Now that we have determined that people of many nationalities enter the US illegally. I don't think we should execute anyone.

Agree with this, however, the issue that the Mexican government is trying to point out, is that on occassion, convicts that were prosecuted for the exact same crimes as American citizens (as in both were taking part in the crime) got death sentence while the Americans got life sentence or even only a few years... due to the ability of the Americans to make a deal with the law or to get better legal deffense. And that appeals pretty much always get refuesed... This and also that there's a higher average of Mexicans getting death row for similar crimes than the White American Male - this sort of issue has been brought up often too regarding how African Americans are more likely to get death sentence too...

Sometimes guys that should get death row don't and sometimes guys who shouldn't, do get it. Justice and law are rarely the same thing.

I always love to read when people say the " Mexican Problem " What about the Chinese problem. Thats the one you dont hear about. Or the Russian, Or those damn people form Canada in their speedo's

As for what mexico is requesting, one of the things they are saying is that the defendants are not allowed the same chances because they are mexican, Thats funny because the US spends BILLIONS on public defenders every year.

It's not the US's fault that the Mexican commited a crime that makes him face the death sentence.

If they commit a crime that has the death penalty what should we do.. let them go? put them in jail on our coin? or let them face the same penalty as anyone else in this country? No one held a gun to their head and told them to enter this country illegally, if they then commit a murder on top of that then they deserve what they get.

right, because an american arrested in mexico would have all these right s afforded to them...

besides shouldn't mexico's embassy provide an attorney and aid to its own citizen in cases like these. i guarantee if i got locked up in another country id be calling the US embassy, for sure.

I'd rather be executed than spend life in a Mexican prison. US prisons are bad enough Mexicans are 10X worse. Be honest only an idiot would think a life sentence is actually better than death whether it be in the US or Mexico.

I hope all the people saying "dont do the crime" arent the same people up in arms when some American is getting the death penalty in Thailand for having cocaine in his bag, or some guy getting jailed in Saudi Arabia cause he had illegal pills in his medicine kit...

wonder how many of you were outraged when that one guy in Singapore got caned years ago for defacing property...

always nice to see how some like to tell others how they should run their justice system yet take offense when others do the same to you.

I agree with the whole "cant do the time? dont do the crime" but you cant use that logic only when it suits you.
