Once I inform a sponser most terminate the account cause if they don't once they are made aware of illegial activity if they don't shut it down then they are implicated and also legally responsible. That is what I was getting at. It is not so bad to have a page not indexed (just try again), but I too have heard that the domain name is banned, though I have never known if that is definitive truth. Maybe someone can provide the definitive truth, with a source.

This is a pretty lame thread...
First, it is very immature and un-professional to go and degrade someone's business... in a forum.
Then, making all thse childish threats about what you WILL DO when you REALLY don't have an arguement.
You cannot sue someone for using a domain that is remotely similar, to gather traffic. There are se's that have been duped, and cannot do anything about it.

That is really far-fetched also... if you don't have an arguement [lack of approved trademark] then the sponsor terminates an account [for a now unwarranted reason] then ............. The sponsor would be held liable for the funds they revoked, plus interest, for terminating a users account for no reason. This would just create a huge clusterfuck, over one domain that merely resembles another. If you want to be successful in your arguements, and not laughed at in the future, for an unsuccessful fight - maybe you should just work out a deal with aleX and be happy.

I personally see a fine line you are drawing, as he probably is not cheating his sponsors, but may be drawing some of your traffic, but I do agree that some sponsors will terminate his account, as most, if not all, reserve that right anyhow. I am surprised that "thehun" is not trademarked, and is pending, but not it Europe. The Hun claims to have won more that one case for someone using a derivitive of "thehun" domain name. TheHun has won Several cases. I've had 2 incidents and I won both.

It's not cool to try and STEAL from someone else, and 99% of all sponsers agree with this cause they have the same probelm with cybersquattors on their URLs.

This asshole was just trying to get me to pay him money for the URL. I sue anyone who tries that. I won't pay a cyber squattor a DIME - but Ii dont' give a fuck if it costs me $10K in legal bills. I set aside about $100K US a year for legal fees on this kind of crap - and since I live near WInnipeg I can get a world class international lawyer for about 1/2 of what other major cites will cost you.

one might be able to get away with this shit on a smaller site, but try it on a larger site with some revenue and you will be the one who gets fucked in the end.

trademarks are most effective on dot coms in the usa cause that's where they are registered and subject in many regards to US legislation.

Cybersquattors take note - once someone has a trademark or is even registered for one it means that person has already invested $1000's into protecting their business. It usually means that there is a lawyer for the site on retainer and the site owner isn't afraid to use him.

If there was a trademark on the terms sleazy I was unable to find one on marksonline btw, then using two "common" words and putting them together doesnt make it ok. THere is case law that can be cited on this unfortunately. (i dont agree with that case however as the findings where way general)

Anyhow with the karas name and the other .nets that are owned he will get approached by the sponsors if they wish and those names will have to be forfeited. Along with those names being forfeited if it can be proven that hes made any financial gains with them then he can be liable for a ton of cash as well under hte anti cybersquatting laws.

Theres a ton of domains involved as it seems. I like to stick to generic names personally but have gotten a few C&D letters in my day from some mainstream folk including mattel, porsche, bmw, massbank, and a couple others... If you play your cards write then nothing really comes of it but if you are arrogant and continue to try to make it seem like you've done nothing wrong then you will end up burned on it.

At least I see him loosing domains, his current sponsors ditching him, or they may slap him on the wrist if hes making htem enough money... he will loose the traffic hes gotten through the engines. he should be blacklisted both in the TGPworld and adult revenue board.

Carlito we've spoken a few times and work together somtimes i would recommend you jump ship and let him find out whats coming. Dont let him bring you down with it as its not worth it, so far you havent done anything wrong. (at least that can be proven so quit while you are ahead)

gl with it and I dont blame you all for being mad you work hard to build a name and traffic then its snagged.

Akex i suggest you contact your registrar or if its you delete the names in question. Dont even botther with trying to talk to people and transferring them to them. Just delete them. If the people contacting you want their name back tell them it will be available for registration after it goes through the cycle period. If they want the name bad enough they can pay you for the transfer costs or else i would delete it. Once you were contacted and told you shouldnt be using the domain... if you kill it you have a lot better of a chance. Then start over doing things legitimately.

Alex delete the ones that are questionable and then im sure you have enough domains left that you can setup and use to build linkpop thats where you will get google traffic from anyhow. You can rebuild your network in a month or two. Its definitely good you are going to take some time to think about it. Goodluck and hopefully it works better this time.

Alex a trademark isnt the be all end all

the problem you will have is that if someone has a site up that is gaining traffic and they have put time effort and money into it. they can sue you for cybersquatting if you are trying to gain profit from their name. You obviously are using the domains in bad faith which is all they have to prove to prove you liable for a lot more than giving htem the name bad. take a look around icann.org tonight and delete the names right afterward. Bad faith doesnt hae to require a trademark.

falsifying whois information is enough i believe to warrant a domain being taken away. Not to mention even if he cant get to you all he has to do is take is file with udrp contact your registrar which would then place it on lockdown so you cant use it anyhow... once udrp begins you will be found uncontactable and would be found guilty and the registrar would be forced to give the name back... or at the very least you couldnt use it anymore.

why take this there. let it die and hoepfully it will all be made right. Go get a day job or work to build a true network.

Alex a trademark isnt the be all end all the problem you will have is that if someone has a site up that is gaining traffic and they have put time effort and money into it. they can sue you for cybersquatting if you are trying to gain profit from their name. You obviously are using the domains in bad faith which is all they have to prove to prove you liable for a lot more than giving htem the name bad. take a look around icann.org tonight and delete the names right afterward. Not to mention even if he cant get to you all he has to do is take is file with udrp contact your registrar which would then place it on lockdown so you cant use it anyhow... once udrp begins you will be found uncontactable and would be found guilty and the registrar would be forced to give the name back... or at the very least you couldnt use it anymore. why take this there. let it die and hoepfully it will all be made right.
