You work on a commission basis, which implies employment by definition. Rather than selling traffic at a set price per "traffic" you are receiving comission for once someone signs up. By that argument you could say that you are selling traffic it the price is set, and doesn't require any further action by the person you sent... So I guess someone that does per click proggies solely could argue that, but you unless you do, you can't. You can keep responding here, with what everyone else has already said, or you could attempt to come up with some intelligent thought, because I'm just repeating myself to yet another idiot here. Like I said, by common sense, you aren't an employee, by definition you are... Good post Dave, though it could still be argued with the 2nd or first definition.
Implicitly, the "terms" that a webmaster agrees too can be considered a contract, and the actions of said webmaster can be held against the employer, as well. Just look at candidclicks, that is an extreme case, but still proves the point... An affiliate can still be considered an "employee" under law, by the fact they have to agree to said terms, and agree to promote under certain guidelines. I'd suppose that if someone wasn't an employee, they could send traffic however they please, and not have clauses for payment or termination... Thanks for the quote, it would be curious to see how it would turn out... I'm still in favor of the common sense employee mindset, but... I like pointing out the other side too... Not only to see everyone with their ego's a flutter, but to get some valid input on it. |

I still think a contract is formed when the terms are agreed to, on both sides of the interaction. All the definitions posted still give way to interpretation. Plus, I don't feel right trusting English Law. Dave |
