You work on a commission basis, which implies employment by definition. Rather than selling traffic at a set price per "traffic" you are receiving comission for once someone signs up. By that argument you could say that you are selling traffic it the price is set, and doesn't require any further action by the person you sent... So I guess someone that does per click proggies solely could argue that, but you unless you do, you can't.
