SPONSOR QUESTION: "Model" domain site/rights....(legal)
Something new comes to mind, so have a quick question and looking for opinions about this...somewhat legal question
Let's say I have a domain of a stage name for model...there is no official site. I've seen a few sites that have have domain names of models and instead of parking them they throw up links to FHG's and label them blah blah's sites or information sites. I believe this is ok to do, but the real question is, if you threw up a site and wrote in first person as Hi my name is Candy whatever, are there any legal repercussions to doing such? One thought is the model signs over all rights to use images and likeness on contract for promotion purposes... Sponsors, your thoughts?

Not sure I am 100% sure what you're asking, but in most cases (I hope) the sponsor/site owner includes the ownership of all names, likenesses, etc. in the contract. In other words, if I contract a girl it is already in my contract that I own the name. Much like McDonald's owns the name McDonald's.

Legally the model can get the domain from you. UNLESS, you either had the domain before s/he started using the stage name, or you made up the stage name for the model.

Legally she does not own her stage name.
ie... Steve Lightspeed owns the rights to Tawnee Stone and Jordan Capri. The girls do not. They have absolutely no say in what happens. Steve however does and he frowns upon affiliates doing this... Pretty much it is an issue where the sponsor will look the other way if you are making them money. If not they can and will take the domain name from you. |
