Hi,

I thought i'd start a thread where all the IPSP's could post their official position regarding dealing with canadian businesses. What we all want to know up here is:

- Do we have to create an US corp or not to keep processing with you?

- If we have to create this corporation, what other conditions do we have to meet? (i.e.: having a bank account there, having a physical presence, what is considered a physical presence, etc.)

Please only post here if you have an official statement from any processing company, as I want people to be able to find the relevant informations easily without going through tons of posts of people making speculations.

This could really help all canadian webmasters, as we are currently held in the dark about these subjects.

Straight from ProBilling:

" We accept most major credit cards including Visa, Mastercard and soon to be accepted, Diners Card, Discover, JCB and AmEx. We also process e-checks, that transfer funds from the user's bank account, and 900billing where a user gets billed on their phone bill. We have a 9.5% fee for credit cards, e-checks and 900 billing, and 3.8% on NETeller transfers.

Our accounts get paid weekly and can get payment by USmail, FedEx, UPS, Electronic Funds Transfer (ACH), Bank wire and Airborne Express.


As of October first, Epoch, Ibill and Ccbill have made a statement that Visa is incorporating some new policies including fees and registration processes for their 3rd party processing accounts.

We have no reason to believe that these new policies pertain to ProBilling or our account holders. Currently we are not incorporating these policies and are not charging any registration, or annual fees. "



I would like to have official statements from all the other companies if possible.

The rules state that for an IPSP may only settle transactions for for webmasters that the IPSP has a bank in that COUNTRY. All 26 Visa Banks have denied to take adult transactions. Currently there is a letter from Visa Canada stating that they do not wish the business, and if Visa USA would like it they do not care. Problem is that Visa USA. Has not ruled it out, but at this point they are not leaning towards allowing US banks to process those transactions.

The rules state that we have to process for US webmaster with a US Visa bank as a result. As of today, unless Visa changes it mind we will require 2 items. A copy of US corporation, LLC etc.. papers and a signed online copy stating you are a US webmaster. You can also us an SSN number or Drivers lic. copy instead of the Corporation.

I am wondering about this part. If I create an LLC in Nevada or in Delaware, I can provide you with my corp ID, and all the legal papers. But, I still cannot provide a statement that I am a US webmaster, because I do not have an american nationality. Or can I provide this statement from my corporation? Ex.: MyCompany Inc. states that it is a US corporation.

I also had another question. If the situation remains the same with VISA, doesn't this new regulation goes against the free trade agreements between Canada, USA and Mexico? Shouldn't I be allowed to deal with a US company if I want to? Has VISA thought of that while writing their new rules?

The US only implemented free trade for their own benefit, though it does seem to infringe on Canadian and Mexican rights.
