Spammer sues ISP?

This article is from June, but has anyone heard anything else about this? I wonder whats up with it.

"Opt-In Marketing Services, an e-mail advertising firm based in Mandeville, Louisiana, has filed suit against its ISP, the backbone provider, and three antispam organizations claiming restraint of trade and deceptive practices."

I had never heard of this before today. Frankly I am glad. Those spammers drive me insane (short drive). Anyway, fuck 'em. They have no rights in my opinion. Maybe once we have some strict federal laws against spam, shit like this won't happen.

Yeah, I know. I read it twice. I sure hope not. But in a country where a woman sued McDonalds because she burned herself on a cup of coffee she "didn't know" was hot and WON you never know what's going to happen.

BTW, did you hear there are now a group of fat people suing some fast food companies because their food "made" them fat?

That was silly. A law needs to come out that when you sue someone and lose, you must pay for their defence legal fees. It would sure reduce the number of bullshit lawsuits.

Sounds to me like these guys are running an opt in list. Even though the # of mails they are sending out would tell me otherwise. Either way, if they are running an opt in list why are they getting cut off? I think they were right to goto court.

Have you actually ready ANYTHING about that courtcase? The basis of the lawsuit was the temperature of the coffee. "Normally" hot coffee does NOT cause the types of burns that woman recieved. There is such a thing as protecting your customers from preventable injury. If I mop a floor and don't have a wet floor sign, I'm endangering my customers' safety. Do you think a company should be allowed to harm their customers? The coffee was MUCH hotter than is allowed in restaurants (there were over 700 previous complaints previous to this one).

While I hate frivolous lawsuits as much as anyone (they've caused insurance companies to raise rates and made medical coverage more expensive, made medical costs more expensive and even caused other prices to be raised), I hate when this case is brought up because the case was anything but frivolous....especially for anyone who's bothered to actually read up on the details of the case.

There was an article in Newsweek about this guy. His argument is that he honors all removes, doesn't forge headers, doesn't use fake e-mails, obeys all laws, etc. but still his ISP shut him down. He said in the Newsweek article that he could easily forge headers and use relays and get away with it and probably make more money but he chose to follow the laws and still got shut down.

We aren't spammers but we are actually thinking about doing the same thing for The Daily Dirt. We are blacklisted in a ton of places even though we run a true double opt-in email list. The only complaints we get are from people who have signed up but still cannot recieve the newsletter because their ISP blocked us. We have already been unbanned by AOL, Yahoo, and Hotmail.

The coffee itself didn't cause those types of burns... Her nylons melted which turned it into a different type of burn situation.. Melting nylons against the skin will cause more damage than just hot coffee..
But ya have to ask yourself.. If the coffee was at the required temperature, would it have still melted the nylons? and if so, the same damage would have been done...

Either way, I still can't believe she put a flimsy styrofoam cup (lid or no lid), full of hot coffee, between her legs to begin with..

That is way dumb...

exactly that's the case.

Btw,expect to receive less spam for a period of time since one of the largest bulkers of all time (DMiner) quits due to a personal issue I got informed today. Reffering to the antispam community he said:

To the anti-spam community, I want to congratulate you on this small victory and impressive effort overall in your endeavourers. I think that we are both in the same boat in that we both have done things we wish we had not had to do, but I think nothing less than this outcome can be expected when the Internet is so insecure, lacks proper legislation and law enforcement, and yet offers so much opportunity. I fault these qualities of the Internet and not spammers or anti-spammers for the general state of e-mail connectivity at the present.
