Has he been libeling TMM / NATS? I have no idea, as I have no idea what the actual facts are. But what I DO know, is that if John actually sues MinusOnebit, and he doesn't scare off, it's going to court.

There, John would have to answer very specific questions under oath about what happened, when he knew about it, and what he did. Also, if it was indeed a hack, if they contacted the authorities, and if not, why not? He'd have to answer questions about OC3's accusations that they publicly made that John threated clients and their own company with lawsuits in order to keep them quiet.

Of course, these clients would then be called too, which means they'd be publicly identified as people that knew about this problem, but didn't inform the industry because, as OC3 has claimed in their threads, they were afraid of John and threats of lawsuits and/or license revocation. If so, would that amount to claims of extortion or coercion?

Again, I have no way of knowing what is or is not true, I can only hash out what's been said publicly in threads by various program owners, OC3 Networks, TMM John, MinusOnebit, etc. But if John takes this to court, we'll all know EXACTLY what took place.

I have to wonder if John is posturing hoping being served is enough to shut minusonebit up, of if he plans on going all the way with his legal action?

The question is, would the truth about what exactly happened be more damaging to TMM/NATS reputation than the things MinusOneBit has been doing, or not?

I think John makes himself out to be the biggest idiot and loser from all of this. He was so worried about what minusonebit was posting that he kept arguing with him and threatening to sue him that it eventually turned into something bigger. I can understand John wanting to protect his company, but come on it is minusonebit. The guy has no credibility around here, what does he do again? exactly. So John should have just said what he minusonebit was posting was false and left it at that. Instead he argues with someone that no one believes anyway and it makes John look worse for it. Because IMO he should have been focusing on real damage control and not board pissing matches with idiots. He should have been working with clients affected and trying to regain their confidence not replying to trolls on GFY. John has no jurisdiction over me in New Jersey. I have not been to the State of New Jersey for at least five years, the last time I was there was to attend the Trenton Computer Festival that college puts on. He can file there, but it will be pitched out and he will have to refile it here. If for some reason the trial court fails to grant my motion to pitch it out for any reason, we move to whats called an interlocutory appeal, where the judge's decision is appealed before the trial takes place, the appeal is heard and decided and then it gets remanded back to the trial court to be tried consistent with the appeals court decision.

John and his legal team will keep coming back to Oklahoma. OKC is not a bad place to stay, and I am the sporting type. I'll see what I can do to round him up some good deals on hotels and dining in the area. After all, the more money I can save him the more he'll have to satisfy the judgment rendered in the cross claim. Any competent counsel knows damn good and well about the jurisdiction issue and therefore filing it in New Jersey is acting in bad faith and in every state it is a crime to sue someone simply for the pleasure of suing them when you know that by doing so you will cost them unneeded expense and should John's company proceed anyway, I will immediately counter sue John's company for all expenses related to defending against it.

Unlike any of the other suits he may have filed against his customers, New Jersey courts have no jurisdiction over me because he has no contract with me. I am not his customer, never considered being his customer and now for certain will never be his customer. I assume the contracts he has with his clients contain a provision whereby they consent to NJ state and federal courts for litigation. That works for them. It wont help him with me.

In that case, I was contacted by another hacker who showed me a flaw in Ameritech's online billing application that allowed anyone with half a brain to get in and see customer phone bills. I took screen shots of five customer's phone bills as proof of access, redacted all names and numbers called except the last two digits of the number and published the story. A week later, sheriff's department was at my door to serve process.

Ameritech WAS contacted before the story was published. They did not return calls or e-mails to their corporate office. They deny ever being contacted. The legal fight was already underway, they were already bitching internally about the use of the ameritechcable.com domain and already had the site on their radar to shut down, and a friend of mine had been holding ameritechdsl.com (long before most people even knew what DSL service was) and he pointed it at my site and then we both decided to make it a public issue.

At least someone is keeping it on the map. It seems a lot of sponsors have decided the cost of moving from NATS is not worth it and will say anything to get this off the map.

I have asked some very specific questions that John will not answer, will not or cannot?

Questions related to exactly what did he fix when it became obvious his system was compromised and how. It took posters here minutes to find the problem in NATS, the login, times, IP and other things. So what fixing did TMM carry out?

Yet it appears he did threaten people who were going to make it public.
Did he change the system to make the IP locking down default or did he keep the compromised system default?
