yes anything produced is actually automatically copyright of the person who did it.
Many companies though simply take someones t.o.s and just reword the text as a lot of t.o.s is very simlar and generic Hope that helps

TOS of many affiliate programs/sites look 95% identical and nobody gives a shit. I am just wondering if i should pay $1500 to a lawyer who will take someone else's TOS and change few words around. I am pretty confident i could do that myself in an hour.

I think what you're probably seeing is most companies using the same adult lawyers for the same forms.
Also the advantage to paying the $1,500 is that if your TOS has problems and it comes to bite you on the ass, you can counter-sue your lawyers for being incompetent. |

If it is 10% different you are ok.
If someone wants to sue you they have to prove what moneys they lost because of what you copied. $0

It makes sense to get a lawyer to write it up, even if it ends up being similar, because you need someone to make sure you are covering all your bases. You don't want to find out down the line that the TOS you copied didn't, and you're screwed.
Besides, you probably need other paperwork anyway, like 2257, warning page, TOS, privacy statements, etc.

If you copy and modify them, at least make sure you don't copy them from an idiot who wanted to safe money on a lawyer and wrote them himself.

If it isn't written in simple english that anyone can read then in my book..... There is no possible way it can be legally binding. Maybe it is (sometimes), but if people can't understand it, and if it's so wordy they can't read it all, then it's garbage. Go back to the 10 simple terms, no spamming, no hacking, no cheating etc. -Ben
