The thread title sounds like "So... i'm bored, wanna go sue someone we don't like today?" - any caselaw on the books for this sort of thing? Is it even winnable? Are they located in a country that doesn't give a fuck?
If your trying to be serious, then let's get a serious thread going here... otherwise....
That is an open and shut case if you ask me. They are making money off something that clearly isn't their to sell.
Well I can sue you for no reason tomorrow. Companies can sue John Doe based on IP address. The question is what are you getting in return? Privacy in Hong Kong is probably different from what you used to. I’m not trying to decoupage your efforts, knock yourself out, but there are reasons why most successful and vicious spammers live in countries like Hong Kong, Russia, the Ukraine..
You most likely won't be able to do shit if he's in China. Therefore I'd target his sponsors (which there is legal precedence for) and potentially the processor and hosts.
Don't think that would work BUT, as far as I know pornography is illegal in China.. think from the other end - theoretically they could get busted by the Chinese government (if they really are in Hong Kong)
Any lawsuit like this would be a very interesting precedent for sure..

I like how you think...
AFF deserves to go down as well for underwriting content theft, if that is what is occuring.

Now who said this thread wasn't serious? He could be exectuted over this shit.

Stand up Jay, You have what it takes .. Money, name.. well your name wont mean shit outside adult webmaster community, but I dare you to do it.. I will contribute to your legal fund.
I can not post URLS but its
en.wikipedia.org/wiki/Kim_Schmitz who Jay is thinking of. I have no idea if he owns it but he had a cool website back in the day and was active in the gumball 2000 stuff
I would be interested in contributing to something like this. Not able to join the class action part.
In other industries I have worked in we have lobbyist who try and get laws changed to protect our interests. Has anyone thought about something like that or contributing to the ones that the regular movie and music industry have?
Actually it's not "IN" China, it's on the bottom of China.
Amazes me China allows it I always thought porn was a big no no there.
At the recent Prague show I bumped into the Commerce Gate rep, the billing company for Megarotic. She said they had some problems with Megarotic but have now been assured the content is legal. After asking her if she was joking she said no they had been assured it was all legal.
What we need to do is keep hitting them, their hosting companies, Commerce Gate and everyone else with DMCA's until something gives.

It's cheaper than lawyers.
They have a site with legal content and payweb does their billing and it is called megarotic...and I suspect it will soon be their only site as the user uploaded content site built the traffic for their legal content site.
When you're running down my country hoss...you're walking on the fighting side of me!
CommerceGate billing (NOCREDITCARD.COM) is processing for them......a lot
of adult companies use NCC for phone billing and such.....I'd first put pressure
on them......CommerceGate is the number 1 choice for processing when you
have illegal content.
Makes far more sense to sue the sponsors. Granter, megarotic will get new ones, but sponsors may be a bit more wary of where they get their traffic if there is a judgment in your favor. Far more winnable to stay in the States and certainly more collectable.
