How to LEGALLY steal someone else's land

Many Western US states have laws that allow trespassers to legally take over someone else's land. This is the legal doctrine of ADVERSE POSSESSION.

If you own vacant land (hoping to develop it later), read up on this or you might get legally 0WN3D like the couple in the news story above.

Normally, the legal requirements for the land user are:
The possession must be open for all to see.

The possession must be exclusive to him or her (e.g., the fence in the above example, a driveway, road, etc.)

The possession must be hostile to the actual owner of the land.

To gain title to land through adverse possession requires strict compliance with the law, but can have dramatic impact upon land ownership rights.
(Some states require that the trespasser pay taxes on the land or demonstrate some sort of otherwise legal compliance)

Indeed. I am, myself, Native American, though I hate that term. I have the papers to prove it, but none of the wealth. I am from Rosebud Reservation in South Dakota. If you saw the movie Dances With Wolves, those are my cousins and family, for real.

I wish we had the dough flowing through some of the other tribe's casinos.

We have a small casino in the Black Hills area. I don't get any money for it, but it has built a hospital, schools, improved some roads. . .and that is good enough for me.

Nothing new. My grand folks lost a few acres on the border of their farm to the neighbors over something like this. Went to court and all. Funny how the neighbors had a real bad turn of luck after that happened. A barn burned down and one year all the crops failed. The authorities said someone dumped "an awful lot" of RoundUp into a fertilizer sprayer that was then sprayed on all the corn that year.

We have an Adverse Possession law here in the Philippines as well. Occupation time is 30 years, I think. Urban squatting, however, is protected by a law called the Lina law. While purportedly upholding property rights, it requires that the land owner provide relocation assistance to squatters.

Is that the law in all states i believe. I know it is here.

10 years if it is unintentional. If you put a fence up and didn't know it was say 10 feet on the other person's property, after 10 years if no one noticed it or asked you to fix it, it is now your property.

If you know something is not your property and you openly treat it as you own, cut the grass, pay the taxes for it, etc.. for 30 years then it is yours.

I dont have any sympathy for the indians. Everyone's ancestors were invaded, enslaved, or oppressed at some point in history. Doesn't matter where you came from. Only difference now is that you don't have to abide by a lot of the same laws as us and you got a sweet deal with the casinos.

Yeah... someone took some land from my grandparent's estate via similar laws.

Tenants of his, living in a house on an adjacent lot to his house, decided to stop paying rent for the year that my grandfather was sick and dying...and continued to do the same for the period of time that my grandmother met a similar fate.

By the time we had gone through all the paperwork, and figured out what had been going on, they had been living there rent-free long enough for the city to determine that they now owned the land after paying out a small stipend to the estate.

You're right, the adverse possession doctrine has been around for a long time.

He might be referring to the US Supreme Court's decision in Kilo vs New London where the Court held that eminent domain can be used by the government to take land from one private individual to benefit another private individual IF the beneficiary's use of the land will result in greater tax proceeds.

To get title, you have to do adverse possession for years or decades.

It seems like a risky business plan, and one that would involve massive legal fees.

Indeed. I agree with you on this, though I am Native American. I tire quickly of things like "reparations for slavery" and other similar topics. If we, as a nation or a world, tried to finanically appease every wrong done through history, we would bankrupt the globe to make a few people feel better or just so they could have some "free" money.

Why not get a little money out of it? Just run an ad in the local paper that reads: "Hunt Humans Today!"

Just have people pay you $50 per person to go hunting on your land. Tell them all animals (including human animals) are fair game. You could even set up a little tent and picnic tables where people can park, get something to eat or drink and swap hunting stories. Bonus: Shoot a squatter and receive a free shot of Jack Daniels.

My great-grandmother actually lived in a tipi as a child and spoke very little English. My own knowledge of the language has faded over the years. As a kid I was fluent. Not it's mostly gone.

If you are actually 50% then you qualify for financial interest in any gaming on your land. Why would you not want to be a rich mf'er?

The Rosebud tribe does own a casino. I suppose I would get some money out of it, if there was ever an excess of cash.

Being located in South Dakota limits the revenue a bit. It's the middle of nowhere. Casinos in Florida or Connecticut and so on have a much easier time attracting patrons.

For now, all tribal gambling revenue is being used for things like schools, roads, power grids, and other vital infrastructure concerns.

I have an awesome photo of my great-grandmother in native regalia, taken around the 1920's or so. Will see if I can get it scanned in and loaded up somewhere. Fascinating picture.

It's a simple law that doesn't affect many people. The easiest solution is just to send a letter saying 'hey you are on my property but I'll let you use it" then they can't get control because you are allowing them to use it or some such gibberish. It isn't a bad idea because if you have property that you never look at for however many yearss it is, then what a waste why not let someone else use it for a purpose?

Tragic, but it has been a recognized legal concept for centuries. Good warning for anyone who owns land, whether it be a home, commercial property, whatever.

If you are an absentee owner of rental property or vacant land, I would be doubly careful.
