Several of the big new york law firms have offices in china.
If I were you I would try to use them if you are serious. I am pretty sure Baker & McKenzie has a large office in China and they are very well established world wide.

Be warned, however, international legal services are not cheap.

you are not getting it so chill out with your comments

We sell vimax on our site as penis enlargement supplement
they sell it on their site as penis enlargement as well,
never mind the same label as ours, which was made by us,

but we had few people try to translate the site and it says that
Canadian based company produces Vimax pills and then it says you can buy them on their site but if they need more info they can go to www.pillsexpert.com

So basically they took our label, took the ingredients and made their own vimax pretending that they are our distributors in asia

oh nevermind I went to another trademark lookup site and 'vimax' showed a different company owned the trademark. Beats me, I have no idea.

Vimax is a quite popular name
many companies use it for other products none of each are related to our product
but again the point is that they are implying that they are our distributor in China/Asia
when we only found out about them from customers emailing us with those urls

A "trademark" can be valid under common law (meaning that it doesn't have to be registered with the U.S. Patent and Trademark Office), and legally protectable.

does pillsexpert own factory production rights to the product? BTW, herbal formulas cannot be patented unless they can be classified for treating a Disease.

So did your own scientists formulate the product and do you own the certificates of analysis and factory flow sheets? Even if you had exclusive rights here in the US, you wouldnt be protected from China.
