Bodog Poker website Siezed in court Judgment - bodog.com was snatched!

Earlier today the Bodog website (bodog.com) went down. Many people thought it was just technical issues. A good friend inside Bodog pinged me and told me that the site was actually yanked out from under Bodog?s hands earlier today.

Apparently, some guy in the US who was awarded a patent for something to do with taking bets online filed a lawsuit against Bodog awhile back. Bodog didn?t respond because they are not a US company. So a judge awarded a default judgment of 50 million.

Yesterday, the guy with the judgment used it to seize control of Bodog?s domain names from Enom. Almost all of their sites are now offline, and now they are going to loose all of their SERPS.

Actually, you have to remember that all registrars work under the approval and guidance of ICANN, based in the US. Technically, all domains are registered in the US and could be seized, or potentially even the entire registrar until they turn over the domain in question. Very, very few people have gone down this road, but the potential is there.

Wasn't there a dispute recently in which a US court ordered the piratebay domain be turned over in a similar matter for a lawsuit that was not contested? If I recall correctly, the Canadian registrar basically said "doesn't apply to us in Canada, sorry" and ICANN said "not under yours or our authority, sorry.".

The .com registry is based in Virginia, and at least for cybersquatting and copyright infringement cases to do with domain names, apparently that is all that is required. ICANN appears to be trying hard to say that there is nothing they can do, but I suspect that with enought pressure, the .com TLD could be forced to deal with non-responsive registrars, or potentially discontinue their registrar status. The agreement clearly states that the agreement is subject to the laws of Virginia, USA.

Actually, I am more surprised that some smart lawyer hasn't gone after the .ORG registry for allowing thepiratebay.org to exist, considering it is certainly not a non-profit organization.

Online gambling isn't illegal, it's all over the place -- licensed fantasy sports leagues and off-track betting on horses, and even the sale of lottery tickets online, where lots of money goes to the state. Online gambling is ok when the state makes money, but it's illegal and "immoral" and a "serious problem" when it's not taxed. It's just that pimps get mad when they don't get their cut.

Worst possible timing to with football season starting this week... As a long time player at bodog I must say the poker tables have been a little slow, however everything is still running. Many of the guaranteed tournaments have been pulled off the board though. Im interested to see how this one will play out. If Calvin steps foot in the U.S he will be immediately arrested, so how they will go about fighting this is beyond me…

Basically Bodog can buy the domain for $11,000,000 if they want it, if not the company will just keep going to court and taking which ever domain bodog is using. The company that filed the suit had the rights to online gaming in some form.

This will not hurt them so bad. The dedicated players will find where there money is and gamble there. They are already back up with a new site and can no doubt have more protection now hopefully not US registrar. Basically the big money players which is biggest % of profits will find the site.
