Hosted offshore but with a US based hosting company ?
Is it ok ? (ya know what i mean) Cause when you're searching for european or offshore hosting, you see guys from Webair and others poping in offering servers in Europe whatever. But they are USA based right ? I'm talking about all the crazy laws and the futur ones that will come out. |

Hosting offshore doesn't mean shit.
If you are a non-US citizen, residing outside the US, your servers are outside the US, and you don't go after US-based business, then you are pretty safe. If you're living in the US and trying to camouflage or dodge out of complying with 2257 by moving your servers offshore, don't bother wasting your time, that will simply draw more scrutiny. However... if you are totally outside the US in every way (physically, banking, domicile, and servers), then you are probably best off doing business with a company that is completely non-US based.

ok, it breaks down like this.... on the contract you sign with your hosting company it should state, blah blah blah is a certain type of business entity incorporated in _____ if that jurisdiction is under US law, then your server still falls under US law no matter where in the world it is. why? because that company still answers to US law at the end of the day.
if you want to host in say Amsterdam, make sure your hosting company has a Dutch B.V.. I do not recommend UK, do some research. at the end of the day, a company like Webair or SplitInfinity is still American owned, so if the FED wants to lean on them to shut you off, they will. your best bet is to deal with an entirely non-american operation from the ground up. as they have no vested interested in listening to the US gov. and no, if you are entirely and securely offshore the US cant make your host do anything as long as you are legal in the country/city that your machines are housed in. beasty porn is legal in certain countries and the US hasn't yet and never will get it take offline. the USGOV is not that powerful. ease up on the paranoia people. ;) and if you think webair or any other US host will keep you up in amsterdam and risk losing thier US holdings, your fucking insane. |
