Need advise: dealing with a arrogant debt collector.

I have a record on my credit from Palisades Collection for an unpaid ATT Wireless bill. The thing is, I never had an ATT Wireless account. Not even Cingular, which was later bought by ATT. There's absolutely no reason why these guys should have my name and especially my SSN. When I requested a proof of debt these guys did send me a bunch of bills from ATT Wireless but no contract or anything signed. The worst part is this "debt" is from 2005 but this agency keeps "refreshing" it on my credit every couple of months.

From the research I have done so far all I could gather is I need to get a State Attorney General involved. I am not sure how much that will help. Any advise?

All you have to do is send them a proof of debt dispute letter (which you can find anywhere online, at least an example) and send it to them certified. Upon proof of receipt they will have to prove the debt valid within 30 days, otherwise according to "the law" they will have to remove it from your credit.

As far as this showing as refreshed every couple of months, well that has to do with the debt being sold for pennies on the dollar all the way down the chain of shit. You have the original creditor that attempts to coolect on the debt, they get sick of it and eventually charge the fucker off. All of the rest that follow do everything and anything to collect even a dollar. Scumbags. Don't pay them it's over. If you made the debt, chalk it up for dumb decisions for not paying in this case AT&T.If you didn't then you need to call your local PD and have them start an investigation into identity theft.

I've had something very similiar happen recently with a Verizon. I've never had an account with them for anything, yet my name appears on a bill, with an address of a state I've never even been in.

I'm going 'round and 'round with the collection people. When I tell them to prove that it is my bill, they just send copies of the bill.

Yes, write to all three credit agencies disputing the entry in your credit report. They must reply within 30 days or remove it.

Regardless, here is what you can do... its called the "1-2-punch" (i did an sem campaign for a debt collection company, so i have some info).

You send the collection agency a letter of dispute, stating you have no knowledge of the account, and request validation made pursuant to the Fair Debt Collection Practices Act. DO NOT sign the letter, you will be suprised how your sig will end up somewhere else.

Send the letter certified mail, return reciept. then the day you get the little green card back, immediately order a credit report adn dispute the trade line on each credit reporting agency.

this is called the 1-2-punch because by law, the collection agency can not verfiy with the credit reporting agency while you have requested validation of the debt. this gives a 30 day window for you to dispute the debt and the collection agency can not do anything until they have 1) validated the debt or 2) the 30 days is up.

according the the FDCPA, if the collection agency fails to follow the set guidelines (verifies the debt with the credit reporting agency WITHOUT validating with you or before 30 days) you can fine them $1000 for each infraction, plus tehy get a slap from the FCC.

in most cases this works wonderfuly. the collection agency would rather drop the debt than get in all sorts of legal trouble. As well, most collection agencies can never validate a debt once it has left the hands of the original creditor.

I did request a proof of debt and got copies of ATT Wireless bills with my name on them. That's what bothers me the most. They look like legit bills. Now, is a bill a proof of debt? I too can generate a bill and send it to anyone I want. Can I somehow legally request that they produce a signed contract? That would put a stop to all this madness since I know for a fact I didn't sign any contracts with ATT Wireless.

As a follow-up the previous post, I did dispute this debt with the credit agencies and it seems that somehow this collector has "proven" this debt to be mine. It now shows on my credit as follows:

[TransUnion] Dispute resolved; customer disagrees
[Experian] Subscriber reports dispute resolved - consumer disagrees.
[Equifax] n/a
