Google sued for 1 Billion dollars

The copyright fight over youtube is getting ugly. A big welcome to Google, the new deep pocket defendant:

Everywhere I look today I keep getting reminded of google getting sued.

Viacom is turning hardcore. They are really trying to make up for the ball being dropped on the MySpace purchase by Mtv / Viacom. MySpace and YouTube stole Mtv's demographic right out from underneath them.

Viacom said YouTube has avoided taking the initiative to curtail copyright infringement on its site, instead shifting the burden and costs of monitoring the video-sharing site for unauthorized clips onto the "victims of its infringement."

Sounds very familiar. What a pity they didn't go after the companies being advertised as well...

yeah, except that MTV is the one producing the content that these sites are profiting from. So they didn't lose their demographic, it is just getting leached away.

Yeah, it sounds EXTREMELY famailar. With any luck this could have a positive effect on adult copyright violations.

Searched page 1, it wasn't there, it was fresh on Drudge.

This is a very relevant story for us, mostly because what Viacom is looking for is relief that goes beyond DMCA, because that act allows infringers to profit until notified, and doesn't oblige them to share or forfeit their ill gotten gains.

An intersting poll on CNN.

1. How do you feel about Viacom's $1 billion lawsuit against YouTube?

Media companies need to protect their rights 16%

YouTube and media companies should negotiate a deal 30%

YouTube shouldn't be liable at all 50%

Not sure 4%

Total responses to this question: 1683

And here is the link http://tinyurl.com/2cbzyc

its not really that fun. most lawyers are theives and will try and take you for every penny they can (unless you konw them personally). I had to sue this guy last year for work that I did for him and money he owed me in advertising. took 6 months to settle and wasnt even a lot.

however, unless you get your hit by paris hilton or a box falls on your head at WalMart, good luck

And I found this comment interesting...

"Catch 22, YouTube is a looser.

YouTube was doomed to fail and heres why.

You either let everyone in the universe upload anything they want or you review every upload. There really isn't any other options.

In the first case, you spend your life in lawsuits and the latter, you cripple the service to unuseability. In the long term, the model just doesn't work."

People world wide are using free hosting services (like rapidshare, imageshack, youtube) to host/share various digital materials, while most of them dosen't have any license to do that. That user uploaded content is making big troubles/losses to movie/music industry. Same is with adult industry.

There are sites (spamfreexxx.com for eg) where you can find links to download copyrighted contents or even full porn DVDs.

I know this area well and I think that this is just the beginning of the lawsutis.

Google has always known about such prospective liability. Must be worth the risk, or Broadcast.com part dos. Interesting game of cards to say the least.

The blatant and rampant disrespect people have for content now a days is sickening. Rapidshare, YouTube and all the similar businesses should be held accountable for every piece of content on their sites.

umm MTV produces TV shows like any other TV station does, but they don't produce the music videos.. that is if Mtv still plays music videos.
