Conference Call with Zango today!

While many companies have opposed their practices, while others seem to endorse it or not care, IwantU.com doesn't like to just sit around (we prefer to lay there unconscious LOL)

I have a conf. call with Zango today in an effort to get something done regarding our keywords/affiliates.

I'll keep you all updated

the most that will happen is the people that buy traffic from them will switch to an affiliate program that doesnt care as long as they get paid

That's a good point, but we unfortunately can't control what other programs will do....hopefully enough people will realize that if something can be done, they will drop programs who don't care to do anything.

UPDATE

Not much got done yet from this call, I'm now waiting on them to go to higher "higher ups", etc.....

However should this attempt fall through, we have a Plan B that will be a lot less 'friendly'...then, well if it has to go to Plan C that involves missing bodies and crocodiles

Varius, I personally think you would be on fairly strong legal ground to require them to stop selling clicks based on your domains as a trigger. There is a concept of "interfering with a business relationship" specifically between you and your customers and you and your affiliates.

If this "attempt" fails, I would highly recommend you get with a good lawyer who understands this sort of thing, look up past settlements and arrangements made (see some of the gain/gator stuff on google) and move forward to protect your business and affiliates from asterixware poachers.

The software can then track users' surfing habits and display content, such as ads, that most users are unaware have no connection with the site they are viewing.

A similar lawsuit was filed in November by the Six Continents Hotels and Inter-Continental Hotels chains, which also alleged that Gator illegally added its pop-up ads to their Web sites, leading to confusion for customers.

Yeap, here you have it. iwantu (no disrespect to them) but a company that makes a lot less then AFF wants to do something about this. Lars from AFF (100million++) a year company doesn't want to protect his trade mark because he said it would be too expensive to do so.

Yes we do own the trademark on our domain name, which is why I can't see why they'd not agree to disallow bids on our domain. I guess they feel we wouldn't pursue any action because we are in Costa Rica, however we do have incorporation in USA, Canada and the UK as well

I will see what Stan says though, hopefully for all involved they'll just agree with us lon before it has to go any further.

Just an update, as Zango now seems to ignore our emails/phone calls, we will be officially sending them a registered letter requesting removal of our trademarks.

Should they still deny our friendly request, we WILL take the next step and pursue.

Maybe they are overconfident because they did win their last case...but that was under much different circumstances, against someone who decided to drop the case because he couldn't get enough support for his class action attempt.

We are not going after any class action, we simply will enforce/protect our trademarks.

Their last case was 100% different. Computer "users" were sueing because their "adware" was put on their computers without their permission and had caused damages to their pc.

Give you a little update from the attornies I talked to over the last couple weeks. It seems none of them want to take on a class action lawsuit on behalf of affiliates/website owners who are having traffic and sales stolen. Personally I think it is easier to show business interference and theft being caused to us then trying to prove damage caused to a surfers computer but for some reason they must see that differently.

Now this is interesting for AFF/ SexSearch, and all who openly use zango and steal traffic from their affiliates... The attornies I spoke with were VERY interested in going after sponsors on behalf of their affiliates. Another reason why sponsors should stop doing business with spyware and stealing from their affiliates.

For you guys, it should be an open shut case. They are tageting your trademark. Look at what potterybarn is doing to AFF. If potterybarn will not allow you to put "potterybarn" in the meta tags of your own site (for fear that you might try to steal their traffic and tarnish their name) What in the hell do you think Zango is doing. It's 10x worse. They are putting your name on their site to allow hundreds of people to steal thousands of thousands of your hits (traffic) a day. They are also tarishing your name by associating it with something that more people then not see as spyware, that pops up on their pc (which they hate and beats their pop up blocker) etc..

Have your attorney read up on the gator cases, it is exactly the same that zango is doing. Once you take down 1 of these spyware companies the rest should fold quick when you contact them to remove your name from their site.
