The US will eventually ruin the Internet

Conservative legislation, lawsuits, two tier system, etc.. The US is going to be the Virus that eventually ruins the net. My latest rant comes from

WESTON, Fla. ? A woman who posted defamatory statements on an online bulletin board has been dealt an $11.3 million blow by a Broward County jury, leading adult entertainment lawyer J.D. Obenberger to say that website operators and Internet users need a wake-up call when it comes to the things they post on industry boards such as GoFuckYourself, hahahahahahahahahaha and others.

“Some court have said sites can remove copyrighted material and child porn without fear of incurring liability akin to that of a media source — that’s an area of the law that is changing,” Obenberger said. “But the minute a site like GFY starts editing out postings for defamation, it opens itself up to liability if it misses a defamatory post.”

I tried to tell board owners this before and they laughed at me.

I'm aware of that, I just think they are picking up steam and will continue to do so until we are hit with a rash of "hot coffee" equivalent litigation.

picking up steam? because you found an article?

first things first... you will need batteries, flashlights, blankets, water proof matches, bottled water, canned food and a bunker in the mountains. once you have insured your own safety and survival and are reasonably sure the world won't implode before your 18th birthday, you can then turn your attention to saving the planet with cut and paste articles backed up with useless opinions, awkward assumptions and crappy analogies.

just because you live in disney world and the land of enchantment, don't pretend that you can't see an obvious problem with someone posting your real name and calling you a child pornographer and pedophile all day long to be archived, linked to and spread across the web for rest of your life.

but then again, if you're digging a bunker in a swamp in orlando... "the rest of your life" shouldn't be too much longer

I'm sorry, let me clarify for those with a low IQ

I understand the need in extreme cases for litigation, I am venting about the rash of "hot coffee" litigation I believe is going to be on the rise.

I'm sorry, I forget to spell everything out word for word two or three times for the retarded.

What is this eventually stuff? They already have.

What will happen is the internet will decentralize, and there will be many internets... all seperate from eachother and probably with few if any crossover links. Which, honestly, might be for the better.

Too many things depend on it to get rid of it completely, but its going to split apart soon. The writing is on the wall.

using the term "hot coffee litigation" as you are, also indicates that you have no clue what that case was about and why she was awarded what she was. defamation is defamation. you posted a link about a defamation lawsuit. a person made liabelous and defamatory statements (repeatedly) with the intent of causing harm to the person that was the object of those statements won a lawsuit. its not like its something totally abstract and senseless like a guy trying to sue a hamster because his wife beats him.

you made the statement "The US will eventually ruin the internet" and you cannot support that statement with anything other than calling me retarded.

suprised your mom isn't using NetNanny to keep you off of sites like this.

You shouldn't have more protection because you are behind a keyboard rather than face to face. I have seen no end of miserable fucks that will post all sorts of shit on the boards, and then they are all smiles and chuckles at conventions and buying you a beer.

It is clear from this judgement that stuff is actionable. There are some people out there that need to wise up.

If you think that the US is going to ruin the internet, then you haven't been paying attention.

The alternative is that the UN runs it, and they have already said that they want to censor it to buggery (ie. you won't be able to criticise left wing or Muslim leaders, etc).

Agree with your orginal post Xanx.

After reading the article referenced it occurs to me that since GFY DOES limit some speech by banning those that make accusations like shaving without proof, may be setting them selves up to be in-line of suit!!

So the point: Is GFY accepting responsibility for all that is said on the board now? That seems to be the direction of the law per the article.

A girlfriend called me recently to go watch TV right away. She knows I work online and I often post in forums. It was on Dr. Phil of all shows.

It was about some site for women to talk about their ex and vent. Many posted pictures of their ex and bashed them. The female forum OWNER was being sued by some guy for something that a poster (one of his ex) had said about him.

The suit was on the basis that she (forum OWNER) had control to delete posts that were "inappropriate". Those that were left without being edited or deleted, damaged his reputation if anyone ever did a search for his name and it affected his career. Both sides made good arguments but it sounded like Dr. Phil and the audience were cheering more for the guy than the forum owner. The vast majority of the audience are women, so go figure...

It was still ongoing so I have no idea what will happen.

Missie

GFY would be kinda boring if this takes hold. The drama would really fall off. I think you see the board changing now with some being more cerful about what and how they say what they post.

Judgements are out of hand on everything. So are governement fines. Ok for the big players that have the bucks. Just cost of doing business. For eveyone else it is a screw job.

Your a local TV station in Salina KS. Population whatever (small) network feeds something raw and you get a $325K fine. More than the budget for several months...

I don't see this as ruining the internet. This is an issue with frivolous lawsuits, not the Internet. It's just reached the Internet now.

I also don't see what you want stopped? Defamation online is rampant and if someone calls you a pedophile with no proof, you have every right to sue for damages. Would you like the internet to be a place where you can post whatever lies you want without reprucussions?

the us is just doing more policing of the net nowadays. i think that mainstream businesses will flourish but the not so mainstream places will not. just wait as more and more legislation gets put into place.

Mmmm.... any "authority" which has control of the net will, in one way or other, screw it up - that can be the US government or the UN. It may be fine for the UN to have a democratic "net governance" committee for a while, but once they get their teeth into the net, hell knows what crazy shit may evolve.

Pressure is back on to remove the net from the control of ICANN and this will happen, prob sooner than later. Other nations are objecting to the lack of democratic "management" of the net and control over their own TLD's blah.

Who knows.. it may actually be good for some countries - as long as they stay on the admin/domain side of net governance, but with others, they will prob screw it to shit and back. That is likely to come for "industrialized" countries first - they have nothing better to do than make local laws about shit.

I don't think the US will lose control over the net anytime soon. They are in a pretty good position and other countries have zero leverage.
