I am being sued?

Weird phone call.

Some chick called from some "settlement company." I get phone calls all the time asking me if I want to let them buy settlements from me. As I have no pending settlements I always blow them off. Today, I asked her why companies seem to think I have a pending settlement that I am waiting collection on.

She tells me that I am the one being sued!

Naturally, I ask for what, and she informs me that on August 17, 2005 some 537 songs were downloaded to my pc via Kazaa.

That is a pretty sweet trick considering I have never even visited their site.

Obviously, if you're being sued by someone you would have been served documents at some point?
Perhaps reporting this practice to the BBB or some marketing watchdog association would help.

probably BS...you never got served right?? They probably do that because they know 90% of people online at one point went to one of those sites and downloaded something, what exactly was she selling??

they do that to unsuspectings so they can "settle" for another decent amount to keep you from getting prosecuted.

Vonage numbers never get shit like that, course I have a number from my old address, kept the same area code so my mom can talk to me without a long distance charge

It's a known marketing "practice" with these scuzzball collection/informer agencies...it's the bait and switch. They bait you into unknowingly admitting to something you didn't do and talking you into their consultations to rectify it.

If it isn’t a scam and it does turn out to be the riaa/mpaa nutjobs one of the greater defenses atm (oddly enough) is going wireless lan instead of wired, and keep your router unsecured. It puts you at a higher risk but if the mpaa/riaa start up shit “lol, I have a wireless router, somebody else did it. My bad”. They seem to have a much harder time proving who downloaded what when just about anybody could have been using your lines.

It is a scam, in fact, I got the impression it was the girl's first day on the job.

First she kept telling me to stop yelling (I wasn't), then she kept acting like she could not hear me before she hung up.

I got the impression she was trying to make her co-workers think she was dealing with a troublesome person. I can't wait for the next call. I will be sure to be really polite and get an address to mail my payment into so I can report them.

my mistake, should have been more clear... "they" was not referring to the people in your post, but the entertainment industry... what you posted does sound pretty scammy, especially if they're demanding payment... try to get a physical address and say you're sending a certified check or something...

Hey Baddog, definately a scam, as you already know. If songs are downloaded they have to do it through your ip address and and your ISP.
Then your ISP company would be in contact and ask you to resolve the issue.

A little update. Happened to find a letter on my desk (from back on July 5) from some law office in Colorado, and sure enough, they say they are suing me and have me listed as a John Doe because they only had my IP and had to wait to get my info from my ISP.

What I find amusing is that if I reboot my modem/router my IP changes, so how the hell do they figure on proving I had that particular IP back in August '05?

This should be interesting.
