Would you first find an unregistered domain (.com) and then register your company under that name? Or would you register a company name regardless if the domain name is taken or not?

but you could also register a company name , trademark it and goto court and get the domain name from the current owner (if you really want the domain). Bit of a bitch though but can be done.

i always try & come up with cool names, then go domain hunting... but ive done the opposite... just browse thru expired domains til u find a cool one then make something of it ;)

Wont work. The company name would have had to be registered before the domain name was registered by the other person.

Just pick an off the wall company name & the domain should be available. Voila!

Do you actually have any sources for this statement?

If company A registers a.com, but doesn't have "A" trademarked, that certainly doesn't mean B can come along years later, trademark "A", and then expect to have a.com handed over to them.

Now if the original A was a company that never really got off the ground, stopped company development, and had no plans for a.com anymore..... Well, that's a different story.

As long as you were using it first and have a current valid reason to be using it, the name is yours. Look at how many movies can't have moviename.com because it's already in use. Sure, they spend $50,000,000 making a movie, but can't get the domain name. There's a reason for that.

Also, go to Oasis.com or Disturbed.com and look what comes up. It's not the popular bands. And everyone knows how record companies are about copyrights.

First have an idea
second choose a domain name
third buy an appropriate available domain name
and then get a business license and hire your lawyer and if he ain't screwing you, then get a bank savings account
