4472 amends already enjoined portions of 2257

I'll bet the 10th Circuit Judge is gonna be pissed off. He wasn't too happy with the DOJ in his rulings, and this attempt to rewrite portions of a law he already enjoined is probably going to end in fireworks.

Most judges will view this as an attempt to usurp their power.

Due to new eminent domain laws, GFY will have to post Walmart banners for free.

I'm looking forward to the legal process on this one.

What does happen when a new bill amends a law with enjoined components, and the currently enjoined components are being amended? Any lawyers care to take a crack at that?

It's gotta be one of:

1) the old law is amended, and the enjoined portions remain enjoined
2) the amended law completely supercedes the original, and the enjoined portions are.. umm.. disenjoined? Is that a word? (see #3).
3) The entire process ends up tied up in court for years.
4) The original judge finds the new amendments invalid on technical reasons - see #3.
5) Well before it's all decided, Bush leaves the white house, a liberal dem is elected, and none of this really matters any more.

I would guess #2, #3, #4.. The problem is that doesnt stop enforcement and arrests along the way, unless an injuction is granted.

#5 doesnt solve the riddle. It's more about what party controls congress and by the vote results, I think this will be a long lasting issue.

#5 will never work. Because the bastard politicians are smart, they keep tacking this stuff on the ass side of bills that the public overwhelmingly supports without thought. "Of course we want to protect children from molesters and killers, so yeah, we support the new law!". They public doesn't realize that protected free speech is getting squished in the back by the tack on rule changes that have no relation whatsoever to the actual intention of the law at hand.

Fucking politicians.

I agree, judge Miller is likely to be perturbed. The whole deal in the very first place was that the doj wanted to overlook the teensy little fact that the idea of secondary producers was already shot down in a previous case. Now they try to rename/reword/rework them right back into primary producer rolls, while the judge is still looking at 2257!

I know I'd be pissed.

There's a lot of hostility right now between many branches of our government, especially between congress and the executive branch.

Arlen Specter is drafting a Bill to enable Congress to sue President Bush.

Man this is like deja Vu all over again.

Really I think what is shocking to people is that a small guy today was raided(or visited). However he does do some extreme stuff as he says for his type of content.

However If you look at what he says...he states they looked over his model releases but did not look at his content. Why? Cause it was gay content of course. This was just a random visit to make a point.
Anabolic/Diabolic? totally understandable. As it is a big company that does do extreme content.

I am sure the judge in the existing case is gonna be pissed. Really in legal terms this is a slap in the face, probably to the highest extreme. It is like a big fuck you from the gov't.
You can bet there is gonna be a mention of this in his final statement and don't be surprised if a ruling comes very quickly, especially after he reads the new law just passed.
