No, not quite. The easiest way is to hire a very knowledgeable attorney (best to have one on retainer if you can afford it) and consult with him (let him do the research). If not, you can do the research yourself but I will warn you, it is a LOT of research and not easy or fun in the least bit. However if you must do the reasearch yourself, you can start by looking up state and local statutes and laws online or by going down to your local law library (if there is one in your area) and doing the research there. That is the problem : you cannot rreally check, because it is kept vague on purpose ...

If you drive a car at 70 mph on a highway, you KNOW that you are breaking the law.
If you allow minors in a bar, you know you are breaking the law. The ages are specified when you get your license.

But for porn, it is left to the prosecutors ... So you end up having to defend yourself, pay for it and possibily get acquitted... and right after, they charge you on another similar vid ... but since it is not identical, your back in court ...

That is a broad definition though that would require further definition to show how it pertains to each individual case. Filming, however, is a different story entirely with different limits and standards (well, if you have actually applied for a filming permit that is). Like I said, if you are not willing or able to retain highly effective or knowledgeable counsel on the matter, you really need to have studied law yourself or at least be very well versed in legal matters.

Thank you Sir! I was actually trying to be kinda funny in a very serious thread, though I know there are a lot of producers out there who haven't done that. Luckily we have a model who's husband is an entertainment lawyer, and he's on top of it as we speak.

Nothing would be a surprise on the Patriot Act - any act with a grand title like that is designed to push buttons for anyone who will listen. That case always did give rise to the possibility of .. eg a US website in Virginia, transmitting content to eg Utah where there is a more than reasonable prospect of offending community standards.

The location and background to Ray's incident and the current climate re political background (elections), smells like another Utah. Doubt that has gone unnoticed by the Florida State Attorney - or any defense trial lawyers.

Bottom line folks - whatever is published on websites, either in text, graphics or video, is open to any law agency within that jurisdiction to lay claims of "obscenity". Obscenity is illegal. The precise definition and any community standards may vary - but the final decider is a jury.

It costs a lot of time, money and resources to defend "obscenity" and, depending of a prosecutors strategy, it is often easier to prosecute ten "small fish" and know that the majority will simply enter guilty pleas and set precedents for attacking "large fish".

Ray is not a "small fish", but the results of any future trial may have an effect on many "small fish" as well as bigger species - it may be a clue to monitor his case and give support where needed.

I have not seen one forced act within the COHF site nor underage girls performing against their will. COHF even features an age system that puts you under penalty of perjury. This is a feature even alot of the cleanest mainstream adult sites don't even possess. I doubt those racketeering or prostitution charges will ever hold up either. Porn is an artform, one that I'm very proud of. I have yet to stumble across one porn site that has diminished that notion of perfection. The motives behind these prosecutors need to be exposed to the fullest extent for public view and open public forum. These are laws that have serious, addressable flaws. North America needs to band together to root out these problems that are attacking our own citizens. That is why I fully praise the efforts of Gov. Schwarzenegger to point out and condemn failures within the Republican government. Politicians must realize preserving liberty in your country is not about winning the most votes before an election by committing heinous acts. How much longer are we going to be made examples of? THe politicians are meant to be the puppets, not the people conducting legitimate affairs and business. I am sick and tired of hearing about 7 and 12 year old girls found strangled and raped in the country. I am sick of hearing about those sickos. More resources, more prosecution, more moeny from the war effort needs to be devoted to preventing them in the first place and hunting those sick bastards down. THe furthest step from the solution ever possible would be to target pornography and devote our tax dollars to telling us what to do with our bodies. I have not seen one forced act within the COHF site nor underage girls performing against their will. COHF even features an age system that puts you under penalty of perjury. This is a feature even alot of the cleanest mainstream adult sites don't even possess. I doubt those racketeering or prostitution charges will ever hold up either. Porn is an artform, one that I'm very proud of. I have yet to stumble across one porn site that has diminished that notion of perfection.
