US Superme court ain't that supreme - is it?

Hypocrisy at its best.
I am not talking about morale/whatever standards the court and actually the entire US justice institutions acts according to.
BUT ? remember the Yahoo Nazi memorabilia case where France asked be taken off and US court said that it?s a US site and is served over the net and it?s a freedom of speech and all?
Well ? back then US word was to protect freedom of speech. Now that it comes to porn, freedom of speech seems like a ?good? enough to sacrifice.
Well ? what do you think is worst and more moral- Porn or Hate/Anti-Semitism? While most of us here on GFY agree (all but some self-promoting hate energized people) US court seems to be unsure of the answer.
I?ll say it again? fucken hypocrisy.
Now they come and say that it?s up to the site owner to control his/her site exposure?
Just one article ? I guess you?ve seen a lot of those?
http://www.wired.com/news/politics/0...2504-2,00.html

Quote:
Justice Clarence Thomas, who wrote the plurality opinion and saw no problems with the idea: "If a publisher chooses to send its material into a particular community, this Court's jurisprudence teaches that it is the publisher's responsibility to abide by that community's standards. The publisher's burden does not change simply because it decides to distribute its material to every community in the nation."
In fact, said Thomas, "If a publisher wishes for its material to be judged only by the standards of particular communities, then it need only take the simple step of utilizing a medium that enables it to target the release of its material into those communities."
Stupid fuck. It seems that this Clarence Thomas ?dude? forgets that there is some stuff around the borders of US called ?the rest of the world?

Next thing the US Supreme Court will approve is hand rectal inspection of passengers in airports due to 9/11 events.

Good point you raised there re jurisdiction. While the federal government does have jurisdiction over all wire/cable/phone communications throughout the US due to the Commerce Clause of the Constitution, it is an open question whether this jurisdiction extends to the Internet.

Once described as "everywhere and nowhere at the same time" the Internet and exercising jurisdiction over it is going to be a landmine for adult webmasters -- specially if courts buy Thomas' "local standards for national distribution" analysis.

And we're not even talking about the COPA yet....

G Sharp. Right.
See... The world is a little bigger than the US.
Will they file a suit against foreign webMasters for using the Internet? Did the Internet become a property of the US government? In that case ? will they repay me for the domains and servers I bought?
Amazing how narrow minded and stupid those judges can be. Does US court expect this rules to apply only to US citizens? In that case ? guyz (US ones) move all to Canada.
And what a fucken stupid idea it is ? to expect webmasters to require a CreditCard to prove age and location. Is that really a qualified judge? What if the site is aimed at Papua-New-Guinians? They don?t have Credit Cards ? they trade with Kinas (local currency). Its what I said before. US court seems to forget that a world exists outside the US borders. It seems US only remembers that when it come to ?wars?. LOL

Kimmykim: you didn?t get 12clicks right? He meant he gets these inspections at home, before he leaves to the airport to see if he didn?t forget anything.

Oh and for all the laffers, Gore DID help to get the US GOVT INTERNET opened to the public. So shove it where the sun don't shime when you want to laff about that. *I* see where all the repub votes have gotten us. lmFao

They simply opened a couple NEW internets up for the schools and military.

The Republicans have done a good job in reducing taxes and helping us keep more of our own money in our pockets. I was a Democrat for many years but I learned that the Dems are only effective when they operate in victim mode - that is their identity. Work hard and be responsible for yourself - that's where power resides.

Hmmmm well *I* was a repub for 25 years AND then went thru Union training that required us to read volumes of the government voting records etc etc. Might want to re-read those records and re think your status. lol They ARE public record after all.

100% of the time the repubs vote for putting that $$ in the BIG boys pockets while allowing a trickle to appease the common man or woman. Thats NOT an opinion, its a fact.

Sure the Dems go for supporting our poor or how ever you want to term them as, but would you rather see a homelss person eat or a rich man have a larger house while paying less tax than a man that makes a tenth of the rich man?!

If you go for the rich mans house you are a sorry piece of work.

Ohhhh and btw,, "Read My Lips, NO NEW TAXES' was the latest flub up by a repub. Dubya just hasn't gotten to daddys snafu quite yet but its coming. He's already burnt up all the extras we had. So when the taxes DO go up for the middle class while the rich pay less, keep yer mouth shut.

GORE IN 2004!

I think you miss my point - work hard - be responsible for yourself.

Is this so hard to understand?

Must have hit a nerve? I don't want to offend anyone here but I think there is power in taking personal responsibility for our actions.

This issue has nothing with little politics nor with taxes and shit.
Its about some stupid judge sticking his head in my dark place where the sun dont shine.
When you trust a 100 y/o judge to make a ruling in a tech related issue without a guidance of experts (as was clearly reflected by his words) and about the court's hypocrisy about the subject of sex online (or sex at all). They are probably angry for not getting free access to some bondage pay-sites.
When 1 ruling of theirs says yahoo (a US site) wont be liable for regulation of france (one local community) nor will have to take actions to "clean-up" or prevent offensive material from reaching that comminuty (because its too comlicated...) AND in other ruling say sex-sites must obey any possible stupid community in the US and that suddenly its up for the "publisher" to take measures (as they said "...need only take the simple step utilizing a medium that enables it to target the release...") I say that court is hypocrit and stupid.

What the fuck is that idea with CreditrCards. If I operate a site fer UK people - why the hell should I take US credit card and zip code just to see where in the US some none-user of mine resides? Its not even a site for US communities...
I say the ruling should be - that a warning page in needed saying
"If you are below the age of 18
OR YOU ARE A STUPID CONSERVATIVE BRAIN-DEAD MOTHERFUCKER WHO HAPPENS TO LIVE IN A FUCKED UP COMMUNITY IN THE US NOT SMART ENOUGH TO REALIZE THERE ARE WORST THINGS THAN SOME GOOD-OLD PORN AND THAT AGREE WITH THE US RULING WHILE MAYBE TOUCHING YOUR LITTLE CHILD IN HIS PRIVATE PLACE OF SENDING HIM TO THE CHURCH TO GET SEXUALLY EDUCATED Click here to go away to a Nazi memorabilia harmless site that will shape your brain back into the 3rd reich.
Note: the Internet is a dangerous place full of free information and you may realize in time that there are worst things that sex (hard for you to believe - I know) so you better rething the whole Internet idea and TELL YOUR FUCKING COMMUNITY LEADERS THAT YOU WISH THEY DISCONNECTED YOUR NO-USE COMMUNITY FROM THE NET

That is very true. Everyone who isn't rich is a victim according to the dems. Everyone who commits a crime suffers from a disease, affliction, social inequity, and should be understood instead of punished.

The dems don't believe in anyone being responsible for what happens to themselves. It's sad.

sorry son, as one of the big boys, I'll tell you that we pay 100 or more times the taxes you do. If anyone deserves a break, its us.
Its sad that you've been completely fooled into believing the democratic fairy tale.
If I pay 750k in taxes for the same services you pay 10k for, I think I should be 1st in line for a tax break. After all, it is *I* not you who is paying for this government. while you complain about the government taking your 36% tax, the government is busy taking my 50%
The Democrats were *SO* right in wooing the uneducated.

dude, you're a communist. If you had money, you'd feel differently.
No one should decide who gets supported by my money except me. Fuck the homeless.
Only by propping up the underclass does a country as a whole decline.
throw the underclass in the river of economic self reliance, those that learn to swim are worth saving, those that don't, aren't

What does that all have to do with the stupid US court ruling?
Dems, repubs and other fucken political zeros are fucken nobodies who play one big zero-profit game and are toys in the big system who dont really care about you people - rich or poor.
But we all had hope that the judicial system is somewhat better than the political system. no?
Well - for the little of us who did so we were apparently wrong. no?
I say - free sites on the net are not really "free".
It generates money who drives the political/economical/capitalist system.
What the fuck is going on there with this COPA BS?
I say - all adult WebMasters should relocate to other countries
Immigration now!
