I personally think her pics are contrived -- but she has/had a monopoly w/ most of the world famous celebrity models... that's why she has so much problem w/ theft. Believe it or not, Boneprone started his site as a HOBBY... and there still are a lot of enthusiast webmasters out there... If you really get to know some of the guys in this biz -- you find out that many of them just like to look at hot babes -- and the money is just gravy.

Lensman presumably has contractual obligations in regard to those payments, although I haven't read his particular set of "we don't have to pay you if you cheat" boilerplate.

It is true, I think, that complying with a properly formed DMCA notice can protect one against contractual damages that result from such compliance. It is also true that there is some dispute about the degree of specificity that must be found in a properly formed DCMA notice.

However, I don't think there can be any dispute that the vague piece of crap email Lensman posted here was NOT, by any stretch of the imagination, specific enough to be a properly formed DCMA notice. (Even assuming that Lensman's situation falls within the scope of the DCMA -- I have insufficient data to know.)

There is a very specific subspecies of lawyer that THRIVES on making insupportable legal threats because it is, as a class, simply too lazy to make supportable ones, and too arrogant to feel the need. Such lawyers are a blight upon the profession. I spit on them. Hock. Ptooie.

You've got to wonder at the mentality and IQ of the people running APIC. The service IS needed on the Internet but these people just haven't a clue. As was mentioned above they can rarely even write an e-mail without typos and bad grammar in nearly every sentence. They're quite frankly a joke. Maybe somebody with a little more sense and legal savvy will set up a decent service and put these clowns out of business. There's certainly an opening there.

Yep, I remember following the whole Absolut saga last year, and at first I thought everyone had gotten their knickers in a knot over a prank, I couldn't believe that email was from a bona fide company. I thought that it was some kid impersonating APIC.

I had to deal with APIC myself due to a Candid Clicks webmaster who was using stolen content.

Just like Lens I asked them the same questions, and of course Steve being the rude unprofessional person that he was would say things like

"Stop wasting my time, I have many other important emails to send out...it's pretty obvious that you're new to the business since you are unwilling to cooperate"

I'm neither new to the business, nor was I unwilling to cooperate. I was simply asking for basic information. Steve was also very unhappy when I told him that I was going to contact the webmaster first, asking for a license, before canning his account.

Steve is the biggest dope I've had to deal with. He goes on rambling how I'm wasting his time, yet he was the one to contact me first wasting my valuable time with his rude emails.

I wish I still had the email conversions handy, would have been pretty funny to post here.

But yeah I have agree with the rest of you, Steve is a unprofessional clown who I'd be embarrassed to represent for me if I were a content provider.

I have had a couple of dealings with APIC - once to defend myself, and another to defend myself. Anytime I talked to someone there, I ended up feeling violated and dirty.

What's really fucked up about this whole thing is that Lensman doesn't HAVE to do anything for APIC.
He isn't hosting, nor does he own the domain where the stolen images reside.

Lensman buys traffic from thousands of webmasters, he has no responsibility for what the webmasters he buys the traffic from do with their sites. Even if APIC sent him undisputable proof that the webmaster in question was stealing content, he has no obligation (legally) to terminate the webmasters account or withhold payment.

He was being a nice guy and was willing to help out until APIC got a real shitty attitude with him and made things personal.

AP supports 50% of copyright violators? Well DUH, AP probably has more active webmasters than any other affiliate program on the net, so that's just a by-product of the size and popularity of the program, its not like he says "Hey, if youre stealing images I'll pay you 6 cents a click"


I don't agree in any way, shape, or form with stealing someone's images. But I for one am glad that Lensman assumed his affiliate was innocent until proven guilty and asked for the specifics, and then was willing to give the webmaster an opportunity to produce a licensce before talking any action :thumbsup


Hey APIC, I don't know how much $$ you get paid for doing what you do, but if you have any left after this is over, there's this book called "How to win friends and influence people", I think you should put reading it on your "to do" list.

Apic worldwide is a bunch of rude unprofessional brats who think they can ruff and tuff anyone on the internet. They lack any respect for anyone and don't know how to deal with webmasters or content providers. Sooner or later someone is going to fly down to Florida and kick some serious azz....

Lens, I had some dopey from apic sending me a rambling letter as well... I figured it was someone with mental problems, but still sent them our standard $100 invoice for processing UCE spam.... hm, that reminds me though... we never collected on that invoice, I'll leave to Intrum tomorrow :winkwink:
