Background:

Only XPays.com and HotelHeiress.com/TrustFundGirls.com have the rights to display images and video from The Paris Hilton Sex Tape via the internet. Authorized images for building tgp's, and authorized materials for promotion are all available at http://XPays.com for your legal use.

What Is happening:

Our partners who possess the copyright to the Paris Hilton Sex Tape have been dmca'ing Google, Yahoo and MSN listed links that:

1) Misuse our copyrighted images and link to unauthorized sites or use our images in violation of XPays terms and conditions.

2) Those who hijack results and link to infringing sites such as nude-celeb-hound. see sample infringing link: http://www.nude-celeb-hound.com/aff/...ilton-nude.htm for example is using our copyrighted image and violating our client's copyrighted content (theft).

What to do on your end:

Immediately inspect your landings and verify that your pages are compliant. Email or call us if you have questions. If you receive a notice from us or our outside firm handling the dmca's and have an XPays account, you will have 24 hours to comply. Should you not comply, your links will suddenly disappear and go ploooooof like many links have before yours .

The Good News:

Legit publishers get more traffic as the bandits, cowboys and thieves are exterminated.

actually the law firm has 2 attorneys on this - then you have both salomon's and 2 of us - so it is a 6 person job and we are running into our own affiliates and trying to both give them a chance to correct while not confusing our contacts at the search engines that our doing a great job on this.

I wouldnt promote lightspeed either. He made his position known when it comes to affiliate links and using his models name to promote his models sites.

Im not complaining about people misusing your clients images im complaining about you targeting good webmasters because they may or may not have linked to a site that misused them. Thats bullshit.

If site A misused an image i can understand you going after him, to go after the other sites that link to him is a fucking joke. Your trying to punish and hurt good people who site A may have mislead.

that is a false assumption- some of the "innocent" webmasters are using our images on their landings to link out to the infringing sites which puts them at ground zero for infringement and don't tell me they are innocently caught up in anything lolololol.

And if your going to dmca AFFILIATES who link to these infringing domains why not post the domains so the honest affiliates can get the links down, do you really think everybody out there is as familiar with whats a legal image and whats not?

I could click through 100 sites on the net and not know where the content came from, and i assure you i do this fulltime.

i have contacted every single one in advance- if they comply they are fine- complying does not mean they are forced to promote us. it means that they either use our content to promote us or not use our content and promote something else for starters. these cases we have been pursuing are not borderline cases I will add- they are crystal clear. in filing dmca, the filer cannot make a mistake because the link owner in question has recourse. We are not new at this either.

we are successfully doing it so far- chilling effects and the cali courts have publicly available info posted re: same. the linking to infringers comment will be understood by those who are doing it.

no it was for clarity sake- i have pdf's saved and lawsuits follow dmca's later as necessary. profiteers of infringing sites have risk btw.

its been shows dmca complaint so far have targetted wrong websites etc ( i.e. no follow up ) .. i expect some changes will take place

example.. If i email google with a dmca complaint and show my records and do the homework and toss 900 links down as dmca violators , google dont check those 900 links , they just comply.. this practise is obviously flawed and open for manipulation..

I.e. i make a video .. i make 500 "fake" websites up that would be "violators" i get them all listed in google. Then i list 500 violators and add xpays.com in the middle as a violator , they will likely pull your domain without asking you. This happened to many people over the perfect10 fiasco ... Well said, and it wont take 500 urls to do it. Thats whats fucked, you know for a fact someone clean is gonna get raped here, it always happens. YES some infringers are going down but so are some straight shooters...its how it happens. And thats bullshit.

Your dmca list should cover infringers, not the people linking to them, you have no way of proving they did anything wrong. The links could have been new, they could have been automatically added via hardlink trade scripts etc...tons of ways.

not a chance- we have been dmca'ng with a 100% perfect track record. we are not in competition to collect se results - only remove the link's that are appropriate. Our affiliate's are kicking ass and we are getting the word out in order to avoid any friendly fire.

steal our content and pay the price. a proactive notice is better than addressing lots of boohoos later.

ask a few of the litigants the salomons already have sued- there is plenty of history to support their intellectual property claims.
