We've all been damaged by someone else's plans / decisions / moves.
There's really nothing we can do about it.
We did not get involved with the P10 guy, others did.
I'm pretty sure that Google could care less about what everyone's motive was. All they care about is stay out of trouble, and they have every right to do so.

JOHNDX 02-01-2006 09:26 PM

Congrats on the FHM plug Met you guys deserve it.

As for the Perfect10 issue, there really isn't a whole lot we can do about it because I don't think any of us purchased the pics from the affiliates. I'm guessing they were all given to us. Therefore, we have no legal standing on the issue. It's up to the affiliate, perfect10 and Google.

Hopefully, the three of them are getting there heads together.

They managed to get themselves off the blacklist...

Oops pardon I meant HEGRE-ART, as you can see the names aer quite close sorry.

Zarathustra 02-01-2006 10:08 PM

its not good business practice for Hegre and Modelflats because now people will think twice before EVER promoting them again and blacklist them as sponsors since they don't care about their affilates by selling their content to p10 and getting the affiliates banned from google

Series 02-01-2006 10:08 PM

2 days and several emails later and not a 'boo' from Hegre... I'm starting to wonder if us affiliates were in fact given content that was exclusive to Perfect 10 :Oh crap

oyvind 02-02-2006 10:09 AM

In reference to Perfect10's DMCA notification to Google, we here at Hegre-Art.com would like to clear a few issues.

In December last year we licensed a few photo series to Perfect 10. Precautions were surely taken from our side, so among others, all affiliates of Hegre-Art.com were of course declared as legal users of our content in the contract. Nevertheless, Perfect10 makes the big mistake of including 105 of our affiliates in their DMCA notification to Google: http://www.chillingeffects.org/notice.cgi?sID=898. They even listed our own affiliate program domain as a copyright infringer : http://www.newnudecash.com/ . Google's reaction was to randomly block some of the sites listed, and therefor some of you have lost your sites main page listing at Google.

In the after shock of this happening, we have made Perfect10 send 2 counter notifications to Google admitting their mistake and asking them to reinstate all Hegre-Art affiliates. So far Google have not reacted, and as the secretive and closed company they are, they have just politely ignored our numerous attempts to solve this issue directly with them.

At this time we are working on getting a court order issued to Google to force them to immediately annul Perfect10's DMCA notice and reinstate the Hegre affiliates that has been blocked. When this has been done, we will evaluate the situation and consider suing Perfect10 for breech of contract and claim compensation for damage.

This is a very unfortunate situation and we can only apologize for the inconvenience and hope that it is being resolved asap. This is as frustrating and damaging for us as it is for you that have been touched by this incident.

We will keep you updated and ensure you that we are pursuing a solution will all our very best efforts.

Hegre-Art.com Staff.

thanks oyvind for the update

and yes you should sue, so this doesn't keep happening: too many people lost money and have already lost too much time with this
the overall damages are probably HUGE

:disgust can't seem to loose the feeling that if it wasn't for that P10 guy, my revenue in January would have grown 30% instead of the 25% now :Oh crap
However, it still beats a mainstream job :pimp

You should also update your affiliates (i.e., me, and 104 others who have DMCA notices on our Google search results).

If I hadn't known about GFY and this thread, I wouldn't know what Hegre-Art was doing to resolve the problem.

I got an affiliate e-mail from Hegre four days ago, and it doesn't mention a thing about Google, Perfect10 (feh!), or your attempts to resolve the situation.

I got lucky--I only had one page nuked, and it wasn't my main page (I don't even run a big site; I'm an erotica author, of all things!).

In any event, Oyvind, you should let your affiliates know what's going on.

1. what's Erro got to do with it now?
2. P10 is the bad guy, he's the abuser
3. you're stil promoting them :)

look, in hindsight it wasn't too smart to sell to P10, but hey now everyone should know, maybe all the other men's magazines should run an add against P10 or warn at least all their photographers

P10 could even go further:
let's remember that a lot/most paysites use non exclusive content, so when P10 would start a second site for which he buys non exclusive content from all the major content providerq, he would do the same thing as he did now: asume he has the exclusive rights and have google ban everyone else
it's the sickest marketing ever

P10 is the badguy, that overstepped his rights and the only reason he can do this, is because he has the money and time to spend on this bullshit

bump out of desperation...

crockett 02-08-2006 11:46 AM

saw this thread was bumpbed and while checking my SE resualts this morring I noticed a listing for a site promoting a TGC site had been removed.

"In response to a complaint we received under the US Digital Millennium Copyright Act, we have removed 1 result(s) from this page. If you wish, you may read the DMCA complaint that caused the removal(s) at ChillingEffects.org."

for the search term "bookbang"

Can't remember if this was posted in this thread or not... http://www.chillingeffects.org/dmca/counter512.pdf ... Counter-Notification looks like a simple process, if you're American.

:winkwink: totally agree, I'm just a little independent affiliate :pimp, where are the big guys

come to think of it, in adult, when do you stop being 'little', what should your income be in a month (because it's hard to compare it with people who aren't in adult, you earn easily 3-5 of what they earn in a month)

Same here. There are others here making six figures and more who are getting bitch-slapped by perfect 10 and just taking it. That's weak.

And Series, thanks, I have emailed Google over this and I plan to file that counter DMCA notice on Monday. My site will be back in the index, but I just wish that *more* would be done to perfect 10 over this.

adultfora 02-10-2006 03:05 AM

Well, it might been written before, but should google not just ban Perfect10 for life - then Perfect 10 has it like they wanna!. Because a image link should be the same as a picture.
But what about altavista.com - they shows all adult pictures and so on!..

the guy is also sueing google and that's his real game

It's a real shame too because there's a real black mark on Hegre and a couple of others at the moment... not that it's their fault, but it is a risk to promote them now... they COULD turn this negative into a positive and come out looking like real HEROS :2 cents: I know that I'd be one grateful affiliate :winkwink: :winkwink:

Erro is totally not involved in this issue. I work very closely with Erro and i"m pretty sure he's not somebody who sells content to anybody. As far as i know he only works with Met Art.

Splum 02-22-2006 07:32 PM

Google got fucking owned, tons of affiliates got owned, Perfect 10 owns all lol.

Downtime 02-22-2006 07:34 PM

google sure is in some trouble now, who's next? guba?

TheMaster 02-23-2006 11:02 AM

Can't Google countersue him over all those false DMCAs?

warlock5 02-23-2006 01:28 PM

Yes, Diebold had to pay someone $125,000 for sending a false DMCA. I think they could be in big trouble, someone should get these facts to Google

oyvind 02-28-2006 02:40 AM

Good News!!

Dear Webmasters

We have some very good news!

As many of you know, Perfect 10 recently filed a DMCA notice with Google against our affiliates. As a result, some of our affiliates became unjustly blocked from Google?s search engine.

Naturally this was not something we could stand for and our lawyers have been working overtime, fighting tooth and nail, to correct the mistake.

We are pleased to announce that as of today all of OUR affiliates are now unblocked by Google.com. As one of our affiliates, and an important member of the NewNudeCash family, we would like you to know that we do not take an issue like this lightly. To ensure this situation does not happen again, we are also taking legal action against Perfect 10.

If you have any questions please feel free to contact us at webmaster at hegre-art.com and we will be happy to help.

Sincerely

The HegreArt Team

Now that was what many wanted to hear methinks :) Good luck with the action against P10. About time that guy stopped getting away with it and got a little of what was due to him coming.

pmates 02-28-2006 03:35 AM

Thanks Oyvind! You've been great to work with over the years and I appreciate you resolving this. I really didn't want to get publicly involved by filing a counter notification, thank you for helping me avoid this.
