US Supreme Court to hear motion to release Chris Wilson

"December 25th, 2005

It?s been announced that the United States Supreme Court has agreed Saturday night to hear a motion filed by Lawrence Walters to have Chris released immediately.

A court clerk agreed to receiver the filings by email, and start considering it immediately. Lawrence is asking that Chris be released on bail immediately. A similar motion to the Florida Supreme Court Friday was denied, on the grounds that it did not have jurisdiction."

Now, The US Supreme Court hearing the case is, hopefully, a positive development.

I'm sure the Polk County judge and sheriff are thrilled at the prospect of being called as witnesses in a First Amendment case given their previous quotes.

The court has only accepted a motion to whether Chris should be released on bail. I don't think the court will be accepting testimony on the motion. They will simply review the case file and briefs. I don't know of an instance where the supreme court would actually take evidence or testimony.

The only time I know of that the supreme court would preside over a case is when the chief justice presides as the Senate acts as jurors in an impeachment hearing.

The Florida Supreme Court did not take sides on the issue, they only said they don't feel they have jurisdiction. I dont know the details on this, but I'll try to get more and put it up on freechris.org.

Correctomundo. The US supreme court is not presiding over the merits of the case itself (yet). This motion is simply addressing the bail revokation and detaining of Chris. If they rule in Chris's favor, the trial will go on as planned, by Polk County, the only difference is Chris will not be held in Jail while awaiting trial.

Like I said I will try to get some more information and get it up there.

I haven't been able to find a hearing date. The court agreed to accept an electronic filing of the motion which helps move things along. Well these days most Federal filings are electronic.... The lower federal courts acually throw the paper away. As for the supreme court, I don't know. Haven't spent time there or studied their rules and procedures.

For Chris I hope it is a quick hearing date and he prevails. Got to give him credit for having the balls to leave the site up. I'd bet Mr Walters advised him of all the possibilities.

Chris is earning a reputation and making history here. The reults of his case affect all of us.

I don't know his motives as I never have talked to Chris, but something tells me he was well aware of the risks and maybe he was willing to take up this war??

Do you have a source on that info? Although the courts are open 24/7, It is unusal I think for them to sit and issue a response on Christmas day.

I'm not an attorney and not familar with all the procedures of the supreme court.

The question will now go back to the Florida Supreme Court this week, who will consider a motion to release him. The ACLU has also filed briefs with the Florida District Court of Appeals to reverse Durrance?s decision as well.

This gonna keep the courts busy for awhile. Mr. Walters appears to be very aggresive in his defence of Chris. Of course he should be... Walters has filed a number of motions. The FSC and ACLU will only help and keep things congested. The more pleadings filed, the more chance for a court to screw up and leave something to grab onto in appeal.

I'm very close to this case, as you know, and at this point, I still wouldn't place bets either way on this one.

I have lots of sources, I regurlarly communicate with Chris, his attorney, and family members. This is where I get the news for freechris.org. I try to get it up there as fast as I can

I was shocked as well at the US Supreme Court considering this on a weekend, better yet Christmas. But this was a court filing through a clerk, and I'm not privy to the mechanics of how it happened, but I don't think there was a lot to it, most likely the brief was faxed to a judge at his home, he/she made thier decision from their recliner. Who knows. What I can tell you is, if anything proves Lawrence Walters is working 110% on this case, this latest move does.

No reason was given for the dismissal, so we can't even speculate at this point about the decision. Maybe they felt the situation could be better handled at the local level, as there are several briefs being considered this week in the Florida Court of Appeals.
