It's still not a protected class as recognized by the U.S. Government. You can fire an employee because he is gay and not face any legal proceedings. However, if you fired an employee because he or she was black then you'd have every law firm in the U.S. foaming at the mouth.

You can beat up a custodian and it would be considered a hate crime if there was proof that you despised custodians and in some freakish way, prejudice towards them. Custodians are not protected by the U.S. Government.
