Legal.... as in fully CAN_SPAM compliant...yea right.

In the other case, why not just join the felons, spammers, scammers, phishers, proxy thieves, and trojan spreaders at our beloved WebAir?

You have to take responsibility for your own email. If you receive 500 junk emails into your inbox daily it is noones fault but your own.

No, most hosting companies shy away from it no matter if it is Legal or not.
If you can prove they opted into the email and are of age to receive adult mail and comply to the can spam act there should be no issues... Hosting companies want nothing to do with it and I dont blame them. Most people dont have the requirements and thats a lot of trust to put into someone when your business is riding on it.

if you wanna do legal spam you need 150 people and tell each one to create a chain letter over aol everyday to 1000 people and you would have 150,000 mails sent out which is highly unlikely

bottom line: if the list is yours (the surfers entered their emails on your site), you shouldn't have much problem finding a place to host it. make sure you tell them you do double optin (although make sure you actually do) and honor removes daily. if spamhaus blacklists you, you should be able to get off the list if you can prove the people signed up via your site.

spamhaus should be shut down tho, they blacklist so many people needlessly, from real optin emails to compliant emails, something needs to be done about them.

anyways, if you bought this list from someone else and are sending unreleated offers, you better get some kind of direct solution with new ips daily.

As you all know by now, mass e-mailing is dangerous in light of the CanSpam Act. In 2005, 4 big players were sued by the DOJ and paid for it as well as entering into onerous settlement orders.

The next 4 DOJ targets, including Cyberheat and Impulse Media, did not surrender so easily. Under the expert representation by Robert Apgood, Esq. of AdultLaw.com, Cyberheat is fighting the DOJ tooth and nail. Like 2257, this law is being used to assualt the Adult Industry. Mr. Apgood and Cyberheat are making sure that the law is applied accurately and according to its terms, rather than those terms sought to be imposed by the DOJ.

I thought Can Spam set legal definitions to seperate fully legal mass emails from illegal mass emails (ie: spam). Such as forged headers, lack of physical address, lack of working opt-out, lack of adult label (if adult).

PR Tom:

It technically does. However, the DOJ is trying to interpret it as a strict liability statute. This is what me, Mr. Apgood and Cyberheat are fighting.

CanSpam for now, is serious because the DOJ IS filing suits. Its not a scare. Its real. Mr. Apgood, myself and Cyberheat are doing something about it.
