Well, first of all make sure YOU own the site design, and not the web artist who designed it. I'm not an attorney, but using photography as an analogy, merely paying for creative work is not enough to own it, unless there is a contract where the artist gives up copyright, or unless the artist voluntarily surrenders the ownership of the design to you in writing.
Of course, if you designed it yourself, then you are home free on that score. If not, you might have more success pursuing a fraud claim, if they are clearly posing as you. Like I said, I'm not an attorney, but speaking as someone who sells creative work to people who usually don't understand copyright law very well, that is how it strikes me. If I do exclusive photo work for someone, it technically continues to belong to me until I cede ownership to them, because most of this work is done without a formal written contract. Of course, I'd never take advantage of this fact (or I'd get a bad name in the business), but these are the legal facts as I understand them.

Well.
I am going to pay his ass a visit in Holland. If that does not work I will ping his server with so many fucken hits it will crash and it will never rise again. I have never heard of that billing company.
Check if the billing company is legit, if it is contact them, give them enough proof he is gone and they will freeze his account, you may be able to recover that frozen amount later. If its not a legit billing company he is trying to steal cc #, call da F B I. matty |

Try contacting his credit card processor with your information and see what happens
Something like " your client bla bla bla... has stolen copyright images and design from us, we ask that you suspend credit card processing from this site, or risk involving yourself in upcoming legal action" Pay your lawyer to send it to them then send the cc processor a registered letter stating the same That sould do the trick, unless the cc processor is in on it

Here is how you do it.
I have 5 raid five servers. "Each one has duel processors and five scuzzy hard drives( built for speed)" I just load his info on all my servers I also have some friends willing to help on theres Then send like 10,000,000 fuckien hits a minute over his way in Holland untill the server crashes. Never ending hits to He will never be able to restore it without changing his ip. Maybe he will get the message then

If it's hosted or billed by companies that are DMCA, then you simply need to notify them with the correct affadavits and he'll be down or the copies will within a day or two at most.
All US billing and hosting companies are DMCA and some additional countries comply as well -- As for the 1x1 sized presents, they are nice but you're apt to get in more trouble than not. Either for what could be a couple of different legal issues, or the guy may have more traffic than you and end up turning it back on you. Think about, get a clear head, and see what you can come up with Paolo |

Serious man, I know you are pissed but don't attack his server with 10 million hits a minute or whatever. Doing that could put you in trouble as well. Handle this the legal way!!!
If you don't want to go the legal route, then fly to Holland and kick some ass j/k. It would really suck if this guy rips your page + you end up in trouble for some DOS attack. Start to notify his host & CC processor. I have a feeling the site will be shudown in good time without the need to force it offline. |

You know when I read things like this, I realize how important it is to copyright graphical works. I've been working on my designs as well, and already I'm worried about being ripped off, because peeps wanna steal. Then again I shouldn't be surprise, it is the Internet.

Someone copied my whole site once and all it took was a nasty letter from my lawyer (me) to get him to take it down.

Well maybe it was not him that actually did it..if he brought a turn key solution then it could actually be him and you that was ripped off. him with his expense you with your content...he has taken it down, so why not contact the design company he quoted...failing that I will kick his arse anyway!!

It doesn't matter who he bought it from, if he bought it or how he happened to have it on his server. If its' a copy, he's busted, period.
I'd keep an eye on him Paolo, as well as going to the web site of whatever design company did this "for" him, and seeing if they've done any other sites the same favor ;) |

For future reference you can now dispute domains legality and get them taken down by using the following.
<a href="http://registerfly.com/info/dispute.php" target="dispute"><font color="#80ff80">ICANN DISPUTE POLICY</font></a> I got this link from registerfly, but most reputable domain registrars follow this practice and have a dispute TOS policy on signing up for a new domain name also Your copied members section is much less use when you can get back all of the stolen traffic by forcing this domain name to be transfered to your company/yourself for little more or less than a standard domain registration You now say you've got the site shutdown... So now dispute the domain name and help prevent this name being used again to steal your traffic, while also getting back some of what should be rightfully yours in the traffic that already goes to the domain name he registered that is yours but with hyphen.
