Well, first of all make sure YOU own the site design, and not the web artist who designed it. I'm not an attorney, but using photography as an analogy, merely paying for creative work is not enough to own it, unless there is a contract where the artist gives up copyright, or unless the artist voluntarily surrenders the ownership of the design to you in writing.
Of course, if you designed it yourself, then you are home free on that score. If not, you might have more success pursuing a fraud claim, if they are clearly posing as you.
Like I said, I'm not an attorney, but speaking as someone who sells creative work to people who usually don't understand copyright law very well, that is how it strikes me.
If I do exclusive photo work for someone, it technically continues to belong to me until I cede ownership to them, because most of this work is done without a formal written contract. Of course, I'd never take advantage of this fact (or I'd get a bad name in the business), but these are the legal facts as I understand them.
