Beware of Dog

Recently a lawyer said that this is a bad idea and puts you in a situation of liability should a guest come by and get bit. Apparently there was a lawsuit where the plaintiff won a judgement and the judgment was upheld on an appeal because a burglar broke in and was mauled by the dog.

Apprently the plaintiff won because the owner of the dog knew full well that the dog was dangerous and even posted a sign about it. Rather than the sign serving as a warning or a hint of caution, it was viewed by the court as an admission of danger.

Crazy.

Have you heard about any crazy lawsuits recently?

Yes, there is some case law on acknowledgement of vicious dogs.

Its a very borderline thing and depends on the state you are in as to how its interpreted.

I've always had signs on all my fences since my dogs have been professionally protection trained.

Its pretty rare for anything to happen though. The minute anyone gets close to a fenced property with trained guards dogs on it, they will more than announce their presence to any intruder. You'd have to be really stupid to get that close to the point where you'd get a bite.

The judicial system is in need of some reform. You can sue for just about anything these days.

Whatever happened to "shit happens"?
