CNN Reporting: Nursing Homes Being Charged in Louisiana

The prosecutions case is essentially that with a Cat 5 hurricane, you (civilians) should have know that the levies would break.

Wonder if the defence will call Michael Chertoff as an expert witness on how to assess the risk of a Cat 5 hurricane and levies.

Actually, nursing homes in Florida have a legal responsiblity to evacuate their patients. Last summer, my girlfriend was working in a nursing home. They had to evacuate the entire thing 4 times. It was a major pain in the ass, but they had to do it to protect the patients. And this is for hurricanes that were not nearly as strong and not headed directly for them.

The fact that these people did not evacuate the old people in that facility when they are required to is absolutely criminal. It is NOT up to the city, It is up the the facility. It's part of the care that you are paying for in that kind of facility.

You ARE required by law if a hurricane is coming, that you MUST evacuate patients under your care in a nursing home. You can't make a judgement call about it, you have to do it even for just a Cat 1

If your mother or father was in that home and the staff just left them there and fled, what would YOU do?

The defence will be citing cases of nursing home residents who were on respirators, oxygen, and those who had other health issues that made any transportation extremely risky.

They claim that they will demonstrate that deaths occured as a direct result of evacutation.

They claim that the Louisiana nursing homes had patients in similiar conditions.

Guess the lawyers will get rich. That is the American way.

..and if they think they don't have enough facilities to do it, they could always call for help, and I think they did not do as well.
