Never use BLUWIRE DESIGNS if you

ever want to get releases for the work you paid for. They will not give you one. They are NOT professional enough.

You should be able to get releases, but you shouldn't expect that they're included with the designs you bought.

Ok...maybe we're thinking of the wrong thing. And if they've promised, they should deliver.

I'm guessing: Model releases for images included in the design?

Unless your contract with Bluewire Designs specifically states they own the copyrights to the designs they produce AND you agree to the terms of the contract, as a work for hire, you own the rights to the designs and don't need a release (under US Copyright law). Be careful about what rights you sign away in a contract.

I had a couple of characters designed for my upcoming site... I needed to get them copywritten and wanted Bluewire to send me a letter stating they designed it and release all rights to me... just for my records to include in my copyright package.

2 sentences on their letterhead... but, can't even get that.

Now I have the characters that say"" Copywritten by... etc and they are not until I get the release and file the package... so I could lose them if someone steals them.

That WOULD explain the difficulty in obtaining model releases.

Hi Guys,
Thank you to those who showed me this thread and who have supported us. I'll take the heat on this one....We did a couple toons for Ray which I may add we delivered ahead of schedule.

Ray and I didnt have a contract but I did tell him at some point during the project that he could have a release. This was at the begining of summer I believe and somehow within our expansions, new office, business trips, 2 family deaths and a REALLY crappy secretary that I had....Ray never recieved his release which was nothing more than a piece of paper with a signature essentially.

I take responsibility for this....my fault, my fault, MY fault. I cant say it any better than that

With that being said, there are a lot better ways to my heart then starting flame threads about our company. If you're gonna go to the boards, a simple "How about giving me my damn release Bluewire!" will do the trick.

I've notified Ray that I'll be putting the release together for him today as soon as our moving company is finished up (still moving in to the new offices). I've also offered him 50% off on a design up to 1k in value if we wants to give us another shot. Sorry for the delays Ray

Hopefully this clears this up guys

We did 2 toons for him. I believe he wants a release for records and he wants to trademark them or something. Not sure. He's the only client in our history that has ever asked for one

Not sure where you came up with that info, but that's false. Designer retains ALL rights to ALL designs unless it specifies Full Rights are transfered in the contract.

Only time this would not be true is if the Designer is an employee of a company and is designing something thru that company, then the company owns the rights.

This is true...In this case there was no contract but ray wanted the rights and I said that was fine by me as long as we can keep in our portfolio
