I love PerfectGonzo and have never received spam from them...BUT, if you have webmasters telling you that they never opted into the list then one of your affiliates is spamming and it is not compliant and they shouldn't have to opt out of something they never opted in to.

You shouldn't be defending this affiliate, you should be terminating him for spam.

Here are a few of his headers from back in May that I missed and didn't get in my delete bin. Every single mail he sends is using a different from name. He changes domains

according to the FTC and Can Spam..

It bans false or misleading header information. Your email's "From," "To," and routing information ? including the originating domain name and email address ? must be accurate and identify the person who initiated the email.

Also in the messages themselves.. Where is his physical postal address? According to Can Spam.

It requires that commercial email be identified as an advertisement and include the sender's valid physical postal address. Your message must contain clear and conspicuous notice that the message is an advertisement or solicitation and that the recipient can opt out of receiving more commercial email from you. It also must include your valid physical postal address.

He is posting the program address and not his. It clearly says sender's. valid physical postal address not the affiliate programs address.

No I just want you to admit the truth its spam trying to look like it follows the can spam rules but it doesn't it looks like it but the emails are not opt in. They are collected from lists where people didn't opt in to recieve spam for your program.

Like I said step up and get the info on where your spammer got his mail from. You don't allow illegal spam so it shouldn't be a problem.

You can keep pretending that he is compliant but I'm sure you will have some explaining to do when we see the story on AVN news about perfectgonzo getting slapped with a Can Spam fines. As we both know, when guys like me are getting hammered by his non opt in mailings you know the general public is too.. so it's only a matter of time before the FTC hammers you.

You know I didn't expect this thread to go 2 pages, I figured it would be a quickie with someone hitting me on ICQ making sure I was off this guys list. I honestly don't care if you guys accept spam I'm just sick of getting it in my webmaster account.. Seems from a quick search on GFY and the fact that this topic is two pages going on three, well seems I'm not the only one.

Maybe you should do something about it, instead of pretending it's not a problem..

I told you if you wish to speak to us we have ICQ & webmaster support. It seems its more convenient for you to post a thread and then sit on your butt waiting to receive an ICQ message.

Hmmm Not sure what part you don't understand. We don't do any mailings.

And for all third parties (affiliates) I make sure they're compliant with our rules. If this guy changed his email (templates or whatever) please email us and I will check them out. Last time (your case, 8 odd months ago) everything was ok.

So you accept webmasters spamming mails that look like they are can spam complient but are not and you don't care is that the conclusion I can draw from this thread?

I asked you if you wanted to prove to me that the mailings followed the can spam rules but you don't lead me to think you can't.

You had a chance to show your company plays by the rules only accepting webmasters that follow the can spam rules but it appearently doesn't interests you to do this makes me wonder if you have anything else to hide.

Good luck with it and I hope for you that rules against spamming don't come to the british virgin islands anytime soon.

Maybe the layout and set up of the mailings is legit, but you have webmasters telling you that they NEVER opted into the mail list, but are receiving up to 10 spam emails a day from one of your affiliates. It has nothing to do with headers or content...but these guys said they never opted in, so why haven't you terminated this affiliate for spamming?

Because he don't care he makes money from it and is located offshore.
He just twists my words I know he is not the one doing the mailings and its one of his affiliates he told me this months ago he just tries to look good.

Why should I do anything but sit on my butt and start this thread? I didn't opt in for the spam, I've hit the opt out in the past.. yet I still get them.

I posted on this board because these posts generally bring results. I figured if I was getting these in my webmaster E-mail account, then I know others are too. So IMO the best place to deal with this is on the boards.

You know as well as I do these are not compliant e-mails they are just faking it. You know I didn't opt in for these mails just like none of the other webmasters that have complained.. Yet you act as if it's no big deal and they guy is compliant.

I'm not going to contact you now after this because I don't trust you.. Next thing you know I'll be on 20 more mailers lists. Of course they would all be opt ins as well..
