Acacia Media Technologies Corp.??

I received a letter today from Acacia, who owns five U.S. Patents and 31 foreign patents covering the transmission and receipt of digital audio/video content via various forms (streaming video, referred to as DMT).

They're basically saying I have not yet entered into a license to use Acacia's DMT technology. They are threatening litigation against us if we don't get a license.

I called them, and I notified them I have so many video streaming services on my site, I have no idea what the hell they are talking about. And the woman, couldn't even tell me what specific streaming service it was.

Can anyone shed some light on this who has experienced this? I'm trying to correct this, but how the fuck am I supposed to if they don't tell me what it is exactly I'm violating!

Thanks guys and gals

Not an attorney, but talking to them may not have been a wise move? You just admitted to doing all kinds of streaming... On the phone and now on a public board. Now they prolly have a file on you (ahh, a hot one!! Let's grab some cash).

All my streaming plugins/videos are paid for monthly by companies I've obtained from GFY. And now, this random company Acacia, from what I understand, wants a percentage of my profits?!?! This is outrageous! Anyone received a letter about this? There is no way in hell I will submit to this. Please, more discussion on this folks!

Thanks!

I got the letter as well. Just like I did a year or so ago.
It was big news awhile back, contact brandon at fight the patent, and also donate to far-L.

They claim they own the patent on all forms of streaming, regardless of where you get your hardware/software.

Do a forum search on Acacia. This has been ongoing for a couple years and has been discussed forwards and backwards.

Take a look on their site for the many licenses they have entered into with companies who chose to license other than fight it. Some pretty big names there. They also claim patent on cable companies/motels video on demand, many which have already coughed up $$$.

Pity a lot of the fools. Many sponsors paid them off.

I'd be a little concerned about having told them on the phone you run so many streaming services. You can't just ignore it if they actually file suit against you

I didn't sign anything, no contracts, nada, simply talked to some hahahaha who couldn't even tell me what I was violating. She just wanted cash apparently.. So thanks for the insight, sounds like you paid them off or something maybe, huh?

I don't run streaming services so no, I have not paid them off.

They just posted on their site today that they entered into licenses with Gannett and Tribune... you don't get much bigger names than those in media...

They can threaten all they want, but you must have missed this summer's ruling from U.S. Court of Appeals. I'm not paying, but maybe you should devote a website encouraging webmasters to do so if you're so interested in helping them out!

WASHINGTON ? In a decision of particular interest to online adult companies, the U.S. Court of Appeals for the Federal Circuit ruled earlier this week that courts should look to the language in the patent itself rather than turn first to dictionaries to determine the meaning of patent claims.

The ruling is expected to have direct impact in the infringement case brought on by Acacia Technologies against online adult companies"

?The new Federal Circuit decision will make it even harder for Acacia to show its patents are valid,? EFF staff attorney Jason M. Schultz told XBiz. ?[U.S. District Court] Judge [James] Ware has already indicated that most of the Acacia patents are too vague and unclear to be valid, and the new Federal Circuit decision reinforces the notion that if you didn't disclose something in your patent, you can't sue people for infringing it. That looks exactly like what Acacia has done.?
