It isn't that bad actually, what if you don't want to view it but it gets sent to you via email with no hints pointing to what it actually is. You view the image; therefore, you download it. Should you be arrested for this mistake? I think not.

I guess . THAT sounds more logical than not arresting people simply for downloading something.
