It's easy for programs to claim "rogue affiliates" do the actual spamming.. What's to stop a program for simply sending mail supposedly from an affiliate? It doesn't take a genious to come up with such a scheme.

Settlement means they admit they broke the law in some way. It would be much cheaper for them to fight it, unless they thought the FTC would win the fight...

Breaking the law isn't okay, and paying a $650k isn't a big deal for a lot of adult companies.. It is a big deal though when it's a fine for breaking the law.

How do you know the programs are not spamming?

What I know is that my mail server has been blacklisted by spamhaus because its at the same place topbucks mail server is at and has a very long history of spamming. I even emailed topbucks about their spamming getting my IP address listed and all they said was they was working an agreement with spamhaus.
So to say some of these programs are not spamming is is just inaccurate.
