What if affiliates were required to...
to sign a contract stating that if they spam or break any of the programs terms and conditions, they would be responsible for any fines that the program would get from the ftc?

I wouldn't have a problem signing it if I were an affiliate, if it were defined in proper detail and clear.

yep, when an affiliate signs up for a new program, they should have to fax back a signed document to the sponsor stating all the stuff. Basically having a hard copy of the agreement.

In all seriousness though, it wouldn't be a big deal. Affiliates who spam will just send to programs that waive that disclaimer and affiliates who don't spam won't mind signing it because it's not even an issue for them.

I thought the standard TOS already had that sort of wording built into them? the limited liability crap or something like that? I think there's a lot more to the FTC thing than we are aware of... When I sign up as an affiliate, check some box saying I've read the TOS and agree to it and will be bound to it, I believe I've already signed a contract. There should be no need for any other crappola.

Even if you could make someone liable to refund your costs, the FTC or whoever would still come after you to pay the fine. You would need to pay them and then separately go after the affiliate to recover the money.
That could be expensive or even impossible if the affiliate were overseas and even if in the US, he/she might not have the money to pay. You could also find yourself in a dispute about the legality of your TOS, your own responsibility for your prosecution, and whether or not you adequately defended yourself. |
