The DOJ wont have the list. Only the "special master" will see it, and compare names of DOJ target with FSC member list. It'll probably be a judge.

Can they go after FSC members retroactively later on? If I go back to using hardcore promo materials that I don't have docs for until the next hearing(then switch back to compliance, of course) can they come after me if there is no further injunction/TRO?
In other words, can they take a million screen shots of websites today and then go after FSC members based on that down the road?? |

I have to say that I disagree with that statement. Yeah, sure, some people are always going to throw money around to they can scoff at the laws but some people like myself, in this case, have worked YEARS to build a legitimate business based upon the existing statutes. I want to scream this out loud since some of you cannot read and understand. This only applies to the plaintiffs in the lawsuit including FSC members and all it does is buy time to get your records in order. Unless a permanent injunction is granted this is still law effective June 23 2005.

I understand the page sent to me to print, fill out, etc., but can someone tell me the criteria that would entitle me to the corporate rates on that page? I file a separate business return (Schedule C) with my company name on it each year with my regular 'ole 1040 return each year, but have never incorporated or anything like that....

IF the injunction is granted it could be MANY years before it can be enforced. I dont know enough to know if this could have been as a class action status and encompassed everyone or not but bottom line all that has happened as of today is that the FSC has bought 40 some odd days. the news is hardly THAT Great a ruling that in its current form 2257 is unconstitutional on just about every level would be much better. That said I do want to give the FSC some credit for picking up the fight on this...I have been critical of them in the past, this time they are doing the right thing and deserve support. |
