I would say that the .xxx announcement jumped xxx.com up in value by a few 100k min.

I'm just trying to imagine the massive typo traffic that xxx.com will be getting.

If it recently changed hands, then XPAYS might go after the new owners, since their registered TM for "XXX" would predate the change of ownership date (which they would then argue is the relevant date to use).

Would be an interesting UDRP, that could go either way.

That one really confuses me and really makes me dislike the trademark office even more and almost as bad as the patent office. How in the hell can the allow a TM on the letters XXX. Hell I might as well trademark Restricted.

That would be the obvious way to defend things, attack the TM registration itself......might get very expensive, though. But, both sides have lots of $$$$, so it would make for a clash of the titans.

trademark one X you will cover all exes

legaly if you have registered XXX entity, such as corp name or a brand name you can have it trademarked. examples would be Apple, Sun, Java, etc. all common words.

I understand that part. In those examples like Apple they are a computer company and nobody could infringe by setting up some computer called an apple, though someone can rightfully use the word apple in a business if say they were for instance a delivery company. Now where if XXX is a company name doing some sort of business and lets say adult entertainment. Not only would there be a great deal of past usage of the word in adult entertainment a TLD by itself is not a business nor a designation of a business. Nothing would stop say for instance a insectiside company from getting a .xxx and it clearly would have nothing to do with adult entertainment.

I remember reading where the estates of the now dead beatles as well the living members legal teams had to remind Apple computer of an agreement where the computer maker wouldnt market music services since the Beatles record label was the original Apple.....

Dont know what happened in the end.
