I understand that part. In those examples like Apple they are a computer company and nobody could infringe by setting up some computer called an apple, though someone can rightfully use the word apple in a business if say they were for instance a delivery company. Now where if XXX is a company name doing some sort of business and lets say adult entertainment. Not only would there be a great deal of past usage of the word in adult entertainment a TLD by itself is not a business nor a designation of a business. Nothing would stop say for instance a insectiside company from getting a .xxx and it clearly would have nothing to do with adult entertainment.
