FAR-L I am not arguing with you
All I am asking is for someone to head the FSC's Division on 2257 for webmasters who knows what the hell they are talking about.

I think it's easy to see that this industry is not very united, and that's because of greed and personal agendas-

I'd like to see a real internet maven on the FSC's board who can make sure that information is dissemintaed properly to people, and the information is correct.

So far I see many people who are Pro- FSC but still do not know what they are fighting for exactly.

I'd love for this business to have a panacea that can magically cure all of our problems. If the FSC is the remedy, then I, along with many others will be truly grateful to them.

They won in the Supreme Court. That makes them your "advocate" whether or not they do one other thing that you think is important.

FSC is an organization with many members. You think that the media is the most important thing. Many people think that fighting for the constitutional rights of their members is the most important thing.

If they don't use their limited resources for legal battles, then their members may end up in jail. All of the media coverage in the world isn't going to overturn existing unconstitutional laws - only court battles will do that.

They have limted resources and they can't do everything. If you want them to do more, then you are going to have to help them get the resources to be able to do that.

If that's what their lawyers told them, what else do you want them to say? Do you want them to make something up that you like better?

If their posting of a legal opinion leaves a sour taste in your mouth, go talk to the people who wrote the laws. I'm sure the Senate and Congress will welcome you.

The FSC started before the internet became the way to distribute porn. Don't fault them for catering to the original member's interests.

I know for a fact they would like to be more useful to the internet side.

So you think paying an additional tax would've been a good thing? I am a business like any other. It is not like we are making toxic waste that needs to be taxed to help the state with the clean up burdon.

The are not afraid to face the media... what on earth gives you that idea?

They have been out there trying to put a positive face on the industry for years. We were all over the media when we went out to defeat that tax.

Im asking questions and giving opinions . The problem with this industry as a whole its very short sighted. Thinking the tax is a bad thing is not the long term thinking it shows us as a legal business, newsflash much harder to fuck with a legal taxable business but we think short term. If are out in the media ,not just local ca media and putting a postive face on our industry you get public support ,thats what truly protects you from the Government but again thats a longterm thing and the industry just thinks in the now. I plan on joining the fsc but I dont see them as my savior. Once again you clear a million a year Jay you should be more than able to fight for yourself.If I made that type of money I wouldnt be hoping someone else was protecting me I would do it myself which leads to another problem in our industry for throwing big parties and buying hummers and rolexes this industry spends big but for important things they become very very cheap lol .

Dear Dumbass,

Why don?t you contact the Supreme Court to tell them you want to make all injunctions all encompassing and tell them to rewrite the Federal Appeals Procedure? Injunctions only cover parties that are in that suit. Like I said, they probably won?t prosecute while an injunction to a law is pending, but it is not the FSC?s fault things are this way.

Tony, I am losing respect for you with every post. Sure, I'm all for a tax -- that would be fine. I don't even know why your are talking about it.

Sure, I make some money. But why should I put up everything I have to be the sole guy to fight this? I'm hardly qualified and they money that I have wouldn't even put a dent in the battle that needs to be fought. We have one organization with real resources that has a MUCH BETTER SHOT than I. JQMedia and OCCash have already contributed heavily to and are members of the FSC. They will get more if they need it.

You are the one that is being cheap and quite stupid, I might add.

Letter of the law is only members. In the vast majority of cases though DA's have not tried to enforce laws on anyone when an injunction was in place.

I've actually leaned a lot about them from this thread. I know the brains behind it (and the guy is very low key) if Jeffery Douglas. I hired him last summer becasue he was reffered to me as the best 2257 lawyer in Califorinia. I didn't even know who the FSC was at the time.

Last summer he was totally well versed on the regs and the internet. He know the shit backwards and forwards. That is a big reason why I feel confident of the organization.

- which known industry attorney works for these guys? Searched around and haven't seen a name, url ,etc.

After seeing the plugs for and the articles against, my opinion is let's get together and offer a 'real' attorney that knows this biz some $$$ to represent us.

I'll gladly pay $500-$1000, whatever, if enough other players will match it to get JB or someone of stature to go into 'go after this stupid ass law' mode.

I may be wrong but Lawrence Walters and Paul Cambria are the two attorneys filing the injunctions on the part of the FSC -- Both East Coast and West Coast.

I'm sure JD will get involved as well, he is chummy with that whole crew.

I admit that when I first heard this my reaction was, "What the hell?" I called Michelle to confirm that this was the FSC position. She explained why, but stressed that the organization seriously doubted that ANYONE AT ALL would get prosecuted if an injunction were issued. She said just that it was POSSIBLE because of the way the law works and who gets covered by a challenge of this nature. Of course the possibility that she was wrong certainly entered my mind. Since talking with her I have confirmed this with several other attorneys not associated with the FSC. All have said that they seriously doubt anyone would ever get prosecuted if an injunction were granted, but admitted that it was POSSIBLE and that the information was technically accurate. Which is the same thing Michelle told me. Anyone who has any questions about this should ask their own attorney.

You are right that the law is the law. And I think you're attorney will confirm for you that it is TECHNICHALLY possible for the governmemnt to charge those people not covered by an injunction, and that those covered TECHNICALLY are those who are party to the suit. That said, I personally feel based on my discussions with the FSC and other attorneys that it would be almost unheard of if the government were to prosecute ANYBODY AT ALL once an injunction were issued.
